Ord 1872 - Zoning Ordinance Establishing a Floor Area Ratio fro Single-Family and Two Family Residences on lots Smaller than 5000 SQ. FT. in all Residential ZonesORDINANCE 1872 AN ORDINANCE TO AMEND THE TOWN OF LOS GATOS ZONING ORDINANCE ESTABLISHING A FLOOR AREA RATIO FOR SINGLE - FAMILY AND TWO FAMILY RESIDENCES ON LOTS SMALLER THAN 5,000 SQ. FT. IN ALL RESIDENTIAL ZONES THE TOWN OF LOS GATOS HEREBY ORDAINS: SECTION I Section 4.10.110 of the Zoning Code of the Town of Los Gatos is hereby amended to read as follows: Section 4.10.110 Floor Area Ratio The objective of the Floor Area Ratio (FAR) is to assist in determining whether the mass and scale of the project is compatible with the surrounding neighborhood. The FAR is a nominal limit not a goal and shall be used in conjunction with the Residential Development Standards adopted by Resolution. The FAR applies to those lots developed or proposed to be developed with a single or two - family dwelling in all residential zones (except the RC and HR zones). The following standards shall be used to regulate new construction: 1. The allowable Floor Area Ratio for all structures, excluding garages, on lots between 5,000 sq. and 30,000 sq. ft. shall be determined by the formula: Floor Area Ratio = .35 - ( -5 X .20) Where: FAR is the Floor Area Ratio A is the net lot area in 1,000's of square feet. (For example, 7,500 square feet is written 7.5). 2. The allowable Floor Area Ratio for a garage on lots between 5,000 sq. ft. and 30,000 sq. ft. shall be determined by the formula: Floor Area Ratio = .10 - ( X.07) Where: FAR is the Floor Area Ratio A is the net lot area in 1,000's of square feet. (For example, 7,500 square feet is written 7.5). 3. The allowable Floor Area Ratio for all structures, excluding up to 400 sq. ft. of garage space, on any lot containing less than 5,000 sq. ft. shall be determined by the formula: Floor Area Ratio = .40 - IT X .05) 4. The deciding body may allow a Floor Area Ratio in excess of the Floor Area Ratio derived by the formulas in subsection (1), (2) and (3) above if it makes the following findings: (1) The design theme, sense of scale, exterior materials and details of the proposed project are consistent with the provisions of: (a) any applicable Landmark and Historic Preservation Overlay Zone: and, (b) Any applicable specific plan; and, (c) The adopted Residential Development Standards; and, (2) The lot coverage, setbacks and Floor Area Ratio of the proposed project is compatible with the development on surrounding lots. 5. Any lot containing more than 30,000 sq. ft. shall be exempt from the Floor Area Ratio limitations. L15 \cnc1rpts \amendfar,zo 2 SECTION II. This Ordinance takes effect 30 days after the date it is adopted. Within 15 days after this Ordinance is adopted the Town clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on September 16, 1991 and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council of the Town of Los Gatos on October 7, 1991.
