Ord 1852 - Amending Chapter 11 of the Town Code Regarding Noise RegulationsORDINANCE 1852 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 11 OF THE TOWN CODE REGARDING NOISE REGULATIONS THE TOWN OF LOS COUNCIL OF THE TOWN OF LOS GATOS ORDAINS: SECTION I. Chapter 11 of the Town Code is hereby repealed in its entirety. SECTION II. Chapter 11 of the Town Code is added to read as follows: CHAPTER 11. NOISE. ARTICLE I DEFINITIONS Section 11.10.010. Acoustics. The ambient or background noise level shall be defined as the continuous equivalent - energy level (Leq) measured for a minimum of three (3) minutes, or until the Leq remains within a one (1) dB spread, and with the noise issue at silent. If the measuring instrument does not integrate the Leq instantaneously, the ambient shall be the average noise level displayed on the meter. Section 11.10.015. A- Weighting. A filter network designed to transform a frequency spectrum to that which is heard by the human ear. 1 Section 11.10.020. Construction. Any site preparation, assembly, erection, substantial repair, alteration or similar action, for or of public or private rights -of -way, structures, utilities or similar property. Section 11.10.025. Decibel (dB). A unit for measuring the amplitude of sound, equal to 20 times the logarithm to the base 10 of the ratio of the pressure of the sound measured to the reference pressure, which is 20 micropascals. Section 11.10.030. Emergency. Activity essential to restore, preserve, protect or save lives or property from imminent danger of loss or harm. Section 11.10.035. Equivalent Energy Level (Leq). The level of a steady state noise that has the same sound energy as a given time - varying noise. Section 11.10.040. Holiday. The term "holiday" shall mean the following days: New Years Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day And any other day as recognized by the Town. Section 11.10.045. Impulsive Sound. Sound of short duration, usually less than one second, with an abrupt onset and rapid decay. Examples of impulsive sound include explosions, drop impacts, and firearm discharge. L10 \cnc1rpts \noise.ord 2 Section 11.10.050. Motor Vehicle. Any and all self - propelled vehicle as described in the California Motor Vehicle Code including all on- highway type motor vehicles subject to registration under said Code, and all off - highway type motor vehicles subject to identification under said Code. Section 11.10.055. Motor Boat. Any vessel propelled by machinery, whether or not such machinery is the principle source of propulsion, but shall include a vessel which as a valid marine document issued by the Bureau of Custom of the United States Government or any federal agency successor thereto (Section 651(d), Harbors and Navigation Code). Section 11.10.060. Multi- Family Dwelling. Any housing unit where two or more dwellings are separated by a common wall and /or floor /ceiling assembly. The State of California recognizes only "single - family" and "multi- family' as terminology. Section 11.10.065. Noise Disturbance. Any sound judged by a reasonable, sane and competent person, which occurs with such intensity, frequency, or in such a manner as to disturb the peace and quiet, endanger or injure personal or real property, or violates the factors set forth in this ordinance. It shall include, but not be limited to noise from the following sounds (this enumeration not being exclusive but only illustrative): 1. The use, operation, playing of any radio, television, musical instrument or instruments, to phonograph, stereo, loud speaker, sound amplifier or other devices for the production or reproduction of sound with louder volume than is necessary for hearing for any person or persons who are in the room, vehicle or chamber in which such machine or device is operated and who are voluntary listeners thereto. L10 \cnc1rpts \noise.ord 3 2. The sounding of any horn or signal device or siren except as a danger warning. 3. The operation of any machinery or tool. 4. The continuous or recurrent acceleration of a motor vehicle or other engine while stationary. 5. Yelling, shouting, hooting, whistling or singing on a public street. Compliance with the quantitative standards as listed herein shall constitute elimination of a noise disturbance. Section 11.10.070. Noise Level. The amplitude of sound pressure referenced to 20 micropascals, measured in decibels, using the A- weighting network (for the purposes of this ordinance). Section 11.10.075. Noise Level Measurement. The procedure shall consist of the usage of Precision Sound Level Meter (SLM), as defined in this Section, set to "Fast" response. If the SLM is analog with a VU meter, then the response shall be "Slow" unless the noise issue is impulsive. The meter must be calibrated before any measurements and the microphone shall be a minimum of 3 1/2 feet from any wall, floor or other large sound reflecting surface. The meter shall be protected from wind or other extraneous noise by the use of screens, shields or other appropriate devices. Section 11.10.080. Noise Sensitive Zone. Any place within the Town of Los Gatos where a person would require peace and quiet, including, but not limited to, all residences, hospitals, schools, churches, parks, nursing homes, child care facilities, hotels and motels. A geographic area within the limits of the Town of Los Gatos that maintains a similar noise exposure (constant noise level over a period of time) over the area. Section 11.10.090. Person. An individual or group of persons, firm, association, partnership, joint ventures, corporation, or any entity, public or private. Section 11.10.095. Powered Equipment. A motorized device powered by electricity or fuel used for construction, demolition, landscaping and repairs. Powered equipment includes but is not limited to: lawn mowers, edgers, leafblowers, saws, sanders, paint sprayers, motors, pumps, blowers, fans, vacuums, nail guns, planes, tractors, bulldozers, loaders, fork lifts, air - conditioners and cooling towers. Section 11.10.100. Powered Toys and Models. Any self- propelled airborne, waterborne or landborne plane, vessel or vehicle, not designed to carry persons, including but not limited to, any model or toy airplane, boat, car, rocket or robotic. Section 11.10.105. Precision Sound Level Meter. A sound pressure level measuring instrument which conforms to the American National Standards Institute (ANSI) specification S1.4 for Type 1 or Type 2 measuring instruments. Section 11.10.110. Property Plane. A two - dimensional boundary extending vertically from the entire length of a line that separates two different pieces of real property. L10 \cnc1rpts \noise.ord 5 Section 11.10.115. Public Space. Any property or structures thereon which are owned or controlled by a government entity. Section 11.10.120. Pure Tone. Any audible sound which can be judged as a single pitch or set of single pitches. Section 11.10.125. Single - family Dwelling. A detached building containing but one kitchen and designed and used to house not more than one family, including domestic employees of such family. Section 11.10.130. Sound Amplifying Equipment. Any device for the amplification of the human voice, music, or any other sound, excluding standard automobile radios when used and heard only by the occupants of the vehicle in which the radio is installed, and as used in this ordinance, warning devices on authorized emergency vehicles or horns or other warning devices on any vehicle used solely for traffic safety purposes. Section 11.10.135. Sound Truck. Any motor vehicle, or any other vehicle, regardless of motive power, whether in motion or stationary, having mounted thereon, or attached thereto, any sound amplifying equipment. Section 11.10.140. Sound. 1. An oscillation in pressure, stress, particle displacement, particle velocity, etc., in a medium with internal forces (e.g., elastic viscous), or the superposition of such propagated alterations. 2. An auditory sensation evoked by the oscillation described above. Note 1: In case of possible confusion the term "sound wave" or L10 \cnc1rpts \noise.ord 6 "elastic wave" may be used for concept (1), and the term "Sound Sensation" for concept (2). Not all sound waves can evoke an auditory sensation: e.g., ultrasound. Note 2: The medium in which the source exists is often indicated by an appropriate adjective: e.g., airborne, waterborne, structure - borne. Section 11.10.145. Sound Level Meter. An instrument comprised of a microphone, frequency - filtering networks, an amplifier, and a display that is used to measure sound pressure. Section 11.10.150. Sound Pressure Level. Twenty (20) times the logarithm to the base ten (10) of the ratio of the sound pressure in question to a reference pressure of 20 micropascals, expressed in decibels (dB). Section 11.10.155. Sound Transmission Class (STC). The preferred single figure rating system designed to give an estimate of the airborne sound insulation properties of a partition or a rank ordering of a series of partitions. Section 11.10.160. Standard. 1. A prescribed method of measuring acoustical quantities. Standards in this sense are promulgated by professional and scientific societies like ANSI, SAE, ISO, etc., as well as by other groups. 2. In the sense used in Federal environmental statutes, a standard is a specific statement of permitted environment. L10 \cnc1rpts \noise,ord 7 Section 11.10.165. Threshold of Hearing (Audibility). The minimum effective sound pressure level of an acoustic signal capable of exciting the sensation of hearing in a specified proportion of trials in prescribed conditions of listening (approximately 0 dB). ARTICLE II DECLARATION OF POLICY Section 11.20.010. Declaration of Policy. The Council of the Town of Los Gatos, California finds that unnecessary, excessive and disturbing noise and vibration is detrimental to the health, safety and welfare of the public and is contrary to public interest. Residents of Los Gatos are to be entitled to the reasonable use and enjoyment of their property without exposure to noise disturbances. The Council of the Town of Los Gatos hereby declares a policy to prohibit such noise and vibration as specified herein, and protect the peace, health and safety of its citizens from such noise and vibration. The standards prescribed hereunder shall be enforceable by the Town's Code Compliance Officer and Police Department. ARTICLE III NOISE LIMITS Section 11.30.010. Curfew -Noise Disturbance. 1. No persons shall between the hours of 10:00 p.m. and 8:00 a.m. make, cause, suffer or permit to be made any noise disturbance which: (a) is made within 100 feet of any building or place regularly used for sleeping purposes; or (b) disturbs any person(s) within hearing distance of such noise. 2. No persons shall make, cause, suffer or permit to be made any noise or sounds which: (a) are unreasonably disturbing or physically annoying to people of L10 \cnc1rpts \noise,ord 8 ordinary sensitivity or which are so harsh or prolonged or unnatural or unusual in their use, time or place as to cause physical discomfort to a person(s); or (b) are not necessary in connection with an activity which is otherwise lawfully conducted. Section 11.30.015. Exterior Noise Levels for Residential Zones. No person shall cause, make, suffer or allow to be made by any machine, animal, device or any combination of same in a residential zone, a noise level more than 6 dB above the noise level specified for that particular noise zone, as shown on the Noise Zone Map, during that particular time frame, at any point outside of the property plane. Section 11.30.020. Interior Noise Levels for Multi- Family Residences. No person shall cause, make, suffer or allow to be made by any machine, animal, device or any combination of same, in a multi- family residential zone, a noise level more than 6 dB above the local ambient (interior), three feet from any common wall, floor or ceiling inside any dwelling unit on the same or adjacent property, except within the dwelling unit in which the noise source or sources may be located. Section 11.30.025. Noise Levels for Commercial and Industrial Zones. No person shall cause, make, suffer or allow to be made by any machine, animal, device or any combination of same, in any commercial or industrial zone, a noise level more than 8 dB above the noise level specified for that particular noise zone, as shown on the Noise Zone Map, during that particular time frame, at any point outside of the property plane. L10 \cnc1rpts \noise.ord 9 Section 11.30.030. Public Property Noise Limits. 1. No person shall cause, make, suffer or allow to be made by any machine, animal, device or combination of same, on public property a noise level more than 15 dB noise level specified for that particular noise zone, as shown on the Noise Zone Map, during that particular time frame, at any point outside of the property plane. 2. Public performances or special events not exceeding 70 dBA at the property plane are exempt from this chapter when approval therefor has been obtained from the appropriate governmental entity. 3. Vehicle horns or other devices primarily intended to create a loud noise for warning purposes, shall not be used when the vehicle is at rest, or when a situation endangering life, health, or property is not imminent. Section 11.30.035. Construction. Notwithstanding any other provision of this chapter, between the hours of 8:00 a.m. to 8:00 p.m., weekdays and 9:00 a.m. to 7:00 p.m. weekends and holidays, construction, alteration or repair activities which are authorized by a valid Town permit or as otherwise allowed by Town permit, shall be allowed if they meet at least one of the following noise limitations: 1. No individual piece of equipment shall produce a noise level exceeding 85 dBA at 25 feet. If the device is located within a structure on the property, the measurement shall be made at distances as close to 25 feet from the device as possible. 2. The noise level at any point outside of the property plane shall not exceed L10 \cnc1rpts \noise.ord 10 Section 11.30.040. Amplified Sound. 1. It shall be unlawful for any person other than personnel of law enforcement or government agencies, to install, use or operate within the Town sound amplifying equipment attached to or housed within any moveable vehicle, boat or aircraft, including sound trucks for the purposes of giving instructions, directions, talks, addresses, lectures or transmitting music to any persons or assemblies in or upon any street, alley, sidewalk, park or public property or any open space generally available to the public, without prior approval via an exception permit granted by the Town. 2. The commercial and non - commercial use of sound amplifying equipment shall be subject to the following limitations: (a) Only music, human speech or a combination of same shall be permitted. (b) The operation of sound amplifying equipment, including outdoor paging systems, for commercial purposes shall be limited to the hours of 8:00 a.m. to 7:00 p.m. weekdays, 9:00 a.m. to 6:00 p.m. Saturdays and 10:00 a.m. to 4:00 p.m. Sundays and holidays, with no time limitations as to non - commercial sound amplifications other than as may be required under Paragraph (d) of this Section. (c) Sound amplifying equipment shall not be operated within 200 feet of any church, school or hospital while any of these facilities are in operation. (d) In all events, the volume of sound and the hours of operation shall be so controlled that the sound will not be unreasonably loud, raucous, jarring, disturbing or a nuisance as defined by the Town Code. Section 11.30.045. Street Sales. L10 \cnc1rpts \noise. ord 11 Offering for sale, selling anything, or advertising by outcry, shouting or the use of a noise making device within any residential, commercial or a noise sensitive zone of the Town, except by variance or permit issued by the Town, shall be prohibited. Exceptions to this provision are the selling by outcry of merchandise, food and beverage at licensed sporting events, parades, fairs, circuses, or other similarly licensed public entertainment events. Section 11.30.050. Animals and Birds. Owning, possessing or harboring any animal or bird which howls, barks, meows, squawks, or makes other noises continuously and /or incessantly for a period of ten (10) minutes or intermittently for 1/2 -hour or more which creates a noise disturbance across a residential or commercial property plane or within a noise sensitive zone shall be prohibited. For the purpose of this chapter, the animal or bird noise shall not be deemed a disturbance if a person is trespassing or threatening to trespass upon private property in or upon which the animal or bird is situated or for any other legitimate cause which teased or provoked the animal or bird. Section 11.30.055. Motor. 1. Motor vehicles. It shall be the policy of the Town to enforce those sections of the Vehicle Code of the State of California regarding motor vehicle noise emission limits and equipment problems which create noise problems, motor vehicle horns, sound levels emitted from off highway vehicles operating off the public right -of -way, and the successors thereof. 2. Refuse collection vehicles. (a) No person shall collect refuse with a refuse collection vehicle between the hours of 6.00 p.m. and 6:00 a.m. the following day in a residential area. (Exception: Any other professional refuse collection company acting as an agent to the Town shall be exempt from the provisions of L10 \cnclrpts \noise.ord 12 paragraph (a) of this sub - section and shall abide by the contract with the Town.) (b) No person authorized to engage in waste disposal service or garbage collection shall operate any truck- mounted waste or garbage loading and /or similar device in any manner so as to create any noise exceeding state or federal standards. 3. Vehicle, motorboat and aircraft repairs and testing. No person shall repair, rebuild, modify or test any motor vehicle, motorboat or aircraft in such a manner as to create a noise disturbance across a residential property plane or at any time to violate the provisions of Article III of this chapter. 4. Standing motor vehicles. No person shall operate or permit the operation of any motor vehicle with a Gross Vehicle Weight Rating (GVWR) in excess of 10,000 pounds, including refrigeration and /or heating units attached to any vehicle weighing in excess of 5,000 pounds, or any auxiliary equipment attached to same, for a period of 15 minutes in any hour while the vehicle is stationary, for reasons other than traffic congestion, within 150 feet of a residential area or designated noise sensitive zone, between the hours of 10:00 p.m. and 7:00 a.m. of the following day. 5. Motorized recreational vehicles operating off public rights -of -way. No person shall operate or cause to be operated any motorized recreational vehicle off a public right -of -way in such a manner that the sound levels emitted therefrom violate the provisions of this chapter. This paragraph shall apply to all motorized recreational vehicles, whether or not duly licensed and registered including, but not limited to, commercial or noncommercial racing vehicles, motorcycles, go- carts, amphibious craft, campers and dune buggies, but not including motorboats. Section 11.30.060. Powered Equipment. L10 \cnc1rpts \noise.ord 13 1. Miscellaneous non - stationary noise sources such as; electric or gasoline lawn mowers, leafblowers, edge trimmers, hedge trimmers and other similar moveable noise sources shall be operated only during the hours of 8:00 a.m. to 8:00 p.m. weekdays and 9:00 a.m. to 7:00 p.m. weekends and holidays in residential or noise sensitive zones. The use of powered equipment in commercial, industrial or public space shall not be time limited. Powered equipment shall be exempt from all other limitations and provisions of this chapter. 2. The provisions of this section shall not apply to emergency work as defined in Article I of this chapter. 3. Powered toys and models. No person shall operate or permit to be operated any powered toy or model, as defined in Article I of this chapter, so as to cause a noise disturbance across a residential property plane or violate the limitations and provisions of this chapter. L10 \cnclrpts \noise.ord 14 ARTICLE IV EXEMPTIONS Section 11.40.010. Exemptions. 1. Safety devices. Aural warning devices which are allowed by law to protect the health, safe and welfare of the community such as, fire, burglar, police and ambulance sirens and train horns, shall be exempted from this chapter. 2. Emergencies. Emergencies and emergency work shall be exempted from this chapter. 3. Town maintenance. Non - stationary powered equipment, including but not limited to street sweepers, landscaping maintenance equipment, construction equipment and other powered equipment used solely for the purpose of improving the quality of life within the Town, used by employees or agents of the Town, shall be exempt from the provisions of this chapter. Section 11.40.015. Exemption Permit Process. If the applicant can show to the Town that a diligent investigation of available noise abatement techniques indicates that immediate compliance with the requirements of this chapter would be impractical or unreasonable, a permit to allow exception from the provisions contained in all or part of this chapter may be issued, with appropriate conditions to minimize the public detriment caused by such exceptions. Any such permit shall be of as short duration as possible up to six months, but renewable upon a showing of good cause, and shall be conditioned by a schedule for compliance and details of methods therefor in appropriate cases. L10 \cnc1rpts \noise.ord 15 SECTION III. The Noise Zone Maps (Maps 112, 113, 126, 127, 139, 140, 141, 152, 153 including Legend) as described in Section II are attached hereto as Exhibit A. SECTION IV. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted, the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a special meeting of the Town Council of the Town of Los Gatos on May 13, 1991, and adopted by the following vote as an Ordinance of the Town of Los Gatos at a regular meeting for the Town Council on May 20, 1991.
