Ord 1906 - URGENCY ORDINANCE SUSPENDING PROVISIONS OF SECTION 14.80.315 OF THE TOWN CODE REGARDING RENT INCREASES TO PASS THROUGH INCREASED DEBT SERVICEORDINANCE 1906 URGENCY ORDINANCE OF THE TOWN OF LOS GATOS SUSPENDING PROVISIONS OF SECTION 14.80.315 OF THE TOWN CODE REGARDING RENT INCREASES TO PASS THROUGH INCREASED DEBT SERVICE The Town Council of the Town of Los Gatos does hereby ordain: SECTION I An urgent need for this ordinance exists in order to preserve the public health and safety in that: 1. A significant number of mobilehome park tenants live on a fixed limited income; and 2. The availability of spaces for mobilehomes in the Town's two mobilehome parks is very limited and zoning requirements allow mobilehomes in the Town only in mobilehome parks; and 3. Significant expenses and costs are associated with moving mobilehome coaches from one location to another; and 4. The supply of low income housing in the Town of Los Gatos is extremely limited; and 5. The Town's current rent control ordinances might be interpreted to permit a new mobilehome park owner to increase rents significantly to pass through the increased costs of financing; and 6. Significant increase in rents in mobilehome parks is likely to result in the constructive eviction of mobilehome park tenants on fixed and limited incomes in an 1 environment where alternative affordable housing is extremely scarce which would result in a serious threat to their health and safety. SECTION II Notwithstanding the provisions of Section 14.80.315, in order to allow review of the reasonableness of the standards and criteria of the Town's Code and regulations, until September 5, 1992, the hearing officer shall deem that all rent increases in mobilehome parks attributable to increased costs of debt service are unreasonable. 2 SECTION III This ordinance takes effect immediately and shall be published once in the Los Gatos Weekly- Times, a newspaper of general circulation, published in the Town of Los Gatos within fifteen (15) days. The foregoing ordinance was passed and adopted at a regular meeting Los Gatos Town Council on the 5th day of June, 1992 and adopted by the following vote as an urgency ordinance of the Town of Los Gatos.
