The primary cause of damage to the curb, gutter, and sidewalk is the overgrowth of tree roots. As Los Gatos is an older community with many neighborhoods with large trees in the relatively narrow planter areas, the tree root damage to the infrastructure is an on -going challenge. Ten percent of the faithful performance bond will remain in effect for a period of two years to guarantee any needed repair and/or replacement caused by defective materials and workmanship. The execution and recordation of the Certificate of Acceptance is now required to finalize the Town's acceptance of the project. CONCLUSION Staff recommends that the Town Council authorize the Town Manager to executive a Certificate of Acceptance and Notice of Completion accepting the work of RPG Engineering Construction Company and authorize recording by the Clerk Administrator. ENVIRONMENTAL ASSESSMENT This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice of Exemption will not be filed. FISCAL IMPACT The project was completed within the budget as demonstrated in the table below.
