RECOMMENDATION: Adopt a Resolution authorizing the Town Manager/Executive Director to direct payment of fees to the West Valley Sanitation District to connect the new Los Gatos Library to the sanitary sewer system in an annount not to exceed $81,715. BACKGROUND: The construction of the new Los Gatos Libruy is scheduled to start in 7uly 2010. `I`he design work for this project was completed in March 2010 and the project is currently advertised through the Town's formal bidding process. The new Los Gatos Library site has no existing utility service comiecfions. Additionally, the construction of the new Library will require relocation of a number of utility facilities to accommodate the new building. Staff has been working with various utility companies to coorduiate design and provide construction services to the new Library. DISCUSSION: One of the major utility needs of the new Library is sanitary sewer service: The Plans call for the general building contractor to route sanitary sewer drains to a conrunon "lateral" line. As part of this work the Library Contractor will relocate approximately 1601ineal feet of 8" sewer line. The sanitation district will oversee and provide inspection of the connection to the sanitary sewer system. West Valley Sanitation.doc PAGE 2 APRIL 19, 2010 MAYOR AND TOWN COUNCIL CHAIR AND MEMBERS OF THE REDEVELOPMENT AGENCY SUBJECT: PROJECT 09-06 -LOS GATOS LIBRARY PROJECT 411-821-2501 DISCUSSION (cont'd): Typically there is fee credit given when new construction includes the removal of buildings contributing to the sanitary system, but in this case, because the structures were in place and connected before the permit process was utilized, no record of original fees paid could established and so no credit could be given by the Sanitation District to the Town. The cost for connecting to the system, a treatnent plant capacity fee, permit processing fee, plan check and inspection fee is $81,715. A letter from the Salutation District detailing the fees and explaining the calculation process (Exhibit A) is included. CONCLUSION: Staff recommends the Town Council/Redevelopment Agency adopt the attached Resolution authorizing the Town Manager/Executive Director to direct payment of fees (Exhibit A) to the West Valley Sanitation District to connect the new Los Gatos Library to the sanitary sewer system in an amount not to exceed $81,715. ENVIRONMENTAL ASSESSMENT: This project is Categorically Exempt pursuant to Sections 15301 (c), and 15303 (e), and 15304 (b) of the State CEQA guidelines. Attachment 1 RESOLUTION RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS AUTHORIZING THE TOWN MANAGER/EXECUTIVE DHiECTOR TO DIRECT PAYMENT OF FEES TO CONNECT THE NEW LOS GATOS LHiRARY TO THE SANITARY SEWER SYSTEM PPW JOB N0.09-06 -LOS GATOS LIBRARY PROJECT WHEREAS, the 2009-10 Capital Improvement Program budget includes funding for the for PPW Job No.09-06 Los Gatos Library Project; and WHEREAS, sanitary sewer service is needed for this project; and WHEREAS, underground sewer facilities have to be relocated around the site of new Library; and WHEREAS, it is necessary for the Town Council/Redevelopment Agency to secure the services of West Valley Sanitation District to provide sewer connection service for the Los Gatos Library Project. NOW, THEREFORE, BE IT RESOLVED that the Town Council/Redevelopment Agency of the Town of Los Gatos hereby approves the attached letter of fee assessment (Exhibit A) with West Valley Sanitation District to provide sanitary sewer connection services in connection with the Los Gatos Library Project in an amount not to exceed $81,715. BE IT FURTHER RESOLVED that the Town Manager/Executive Director is hereby authorized and directed to pay sewer connection fees on behalf of the Town CounciURedevelopment Agency.
