Ord 0597-NORTHWEST NUMBER FOUR ANNEXATIONORDINANCE NO. 597 AN ORDINANCE APPROV'ING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "NORTHWEST NUMBER FOUR ANNEXATION;: TO THE TOWN OF LOS GATOS THE TOWN COUNCIL OF THE `OWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: WHEREAS on the lst day of ! Imlay 19 Gal , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the _Town of Los Gatos, said territory being therein designated as `INorthwest Number Four Annexation's , and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution dial contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the dare of the passage of said Resolution; and WHEREAS, on the lr th day of June , 19 61 , at the hour of S:OO o'clock P..in the Los Gatos Council Chambers in the Town Hall of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for bearing protests to said.annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page of Pages a Y the value of the territory proposed to be annexed as determined by said legislative body; and WHEIEAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1039, particularly Government Code Sections 35300 and 35314 inclusive have been fully complied with; NOW, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, -.s all that territory situate in the County of Santa Clara, State of California., more particularly described as follows: Page of Pages Beginning at the Northeast corner of Lot 8 of the subdivision shown upon that certain map entitled "Robison H4ights", Tract No. 473, which map was filed for record in the Office of the Recorder of the County of Santa Clara, State of California, on April 6, 1948, in Book 18 of Maps, Page 7, said point of beginning being in the Town Limits of the Town of Los Gatos; Thence, Southerly along the Easterly line of said Lot 8, Robison Heights, and Westerly along the Southerly line of said Lot 8, Robison Heights to the point of intersection of said line with the Easterly line of E3 Rancho Avenue; Thence, Southerly along the Easterly line of said El Rancho Avenue to the point of intersection of said line with the Southerly line of said E1 Rancho Avenue; Thence .4 Westerly along the Southerly line of said El Rancho Avenue to the point of intersection of said line with the Easterly 'iuA of that certain Parcel No. 1 of land as conveyed in the Deed from Lewis and Kaufman, Inc., a California Corporation, to Howard A;, Michelson., et ux, dated 4anuary 22, 1952, recorded January 23, 1952, in Book 2354, Official Records, rage 67, Santa Clara County Records; Thence, f olloveing the exteriox boundaries of said last named Parcel No. 1 conveyed to Michelson Southerly and Westerly to the point of intersection with the most Westerl - line of Parcel No. 2 of said h.ereinbefo--e mentioned :'seed to Michelson; Thence, Southerly along said Westerly line of said Parcel No. 2 conveyed to Michelson to the point of intersection of said line with the Southerly line of the subdivision shown upon that certain map entitled "Pleasant View Heights", Tract No. 456, which map was filer for record in the Office of the Recorder of the County of Santa Clara, State of California, on March 8, 1948; Thence, Westerly along said Southerly 14-14ne of Pleasanter View HI eights, Tract No. 456 to the point of intersection of said line with the Easterly line of that certain Parcel No. 2 described in the Decree Establishing Fact Of Death Of Joint Tenant, the Estate of John Cisero, recorded June 17, 1960, in Book 4828, Official Records, Page 418, Santa Clara County Records; I 0 Thence, following the exterior boundaries of said last named Parcel No. 2 described in the Decree Establishing Fact Of Death of Joint Tenant, the Estate of John Cisero, Southerly and Westerly to the point of intersection with the Easterly line of the San Tomas Aquino Road (Presently Santa Clara-Los Gatos Road) as the same now exists; Thence, Westerly along the Westerly prolongation of the South- erly line of said Parcel No. 2 of Cisero to the point of intersection of said line with the Westerly line of the San Tomas Aquino Road (Presently Santa Clara-Los Gatos Road) as the same now exists, said point being a point in the City Limits line of the City of Monte Sereno; Thence, Southerly along the City Limits line of the City of Monte Sereno and the Westerly line of San Tomas Aquino Road, (Santa Clara-Los Gatos Road), as the same now exists, to the point of inter- section of said line with the Westerly prolongation of the center line of Farley Road, as the same now exists; Thence, Easterly along the Westerly prolongation of said center line of Farley Road and further Easterly along said center line of Farley Road to the point of intersection of said line with the Easterly right-of-way line of the Sizr;:thern Pacific Railroad Company; 'thence, following the vario:-s courses and distances of the Easterly right-of-way line of the Southern Pacific Railroad Company Northerly to the point of intersection of said line with the Easterly prolongation of the Northerly line of the hereinbefore mentioned Lot 8, Robison Heights, Tract No. 473, said point being also a point in the Town Limits of the Town of Los Gatos; Thence, Westerly along the Easterly prolongation of said Northerly line of said Lot 8, Robison Heights, Tract No. 473, and along the Town Limits line of the Town of Los Gatos to the point of beginning. 2 Introduced at an Adjour-ned meeting of the Town Council of the Town of Los Gatos, State of California, on the 13th day of June 19 SI PASSED AND ADOPTED AS AN ORDINANCE OF THE TOWN OF LOS GATOS, CALIFORNIA, AT A Regular MEETING OF THE TOWN COUNCIL, MELD ON THE 19th DAY OF June ! 1961 1 AYES: COUNCILMEN James E.
