Ord 0589-BUENA VISTA HEIGHTS NUMBER ONE ANNEXATIONORDINANCE NO. j ey AN ORDINANCE APPROVING THE ANNEX.ATIOIT OF CERTAIN UNINHABITED TERRITORY, DESIGNATED " BUENA VISTA. HEIGHTS NUMBER ONE ANNEXATION" TO THE TOWN OF LOS GATOS THE TOW COUNCIL OF THE T07IN OF LOS GATOS DOES ORDAIN AS FOLLOWS: WHEPX-AS on the 20th day of March 19 61 , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the Town of Los Gatos, said territory being therein designated as "Buena Vista Heights Number One Annexation'.' and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and WHEREAS, on the 1st -day of May , 19 61 at the hour of S=OO o'clock p.m. in the Los Gatos Council Chambers in the Town Ball of the Town of Los Gatos, County of Santa Clara, State of California., said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page of Pages • the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1039, particularly Government Code Sections 35300 and 35314 inclusive have been fully complied with; Wow, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page of Pages Beg#uniog at the Northeasterly corner of that certain parcel of land as conveyed in the Deed from James A. Franklin and N. Gwendolyn Franklin to James A. Franklin and N. Gwendolyn Franklin, as joint tenants dated October 20, 1955, recorded October 27, 1955, in Book 3316, Official Records, Page 372, Santa Clara County Records, said point of beginning being also a point in the Town Limits line of the Town of Los Gatos.; Thence, following the various courses and distances of the Town Limits line of the Town of Los Gatos Westerly to the center line of the San Tomas Aquino Road (Presently Santa Clara-Los Gatos Road) as the same existed prior to June 30, 1954; Thence, leaving the Town Limits line of the Town of Los Gatos and following on and along the various souses and distances of said center line of said San Tomas Aquino Road (Presently Santa Clara- Los Gatos Road) generally Northerly to the point of intersection of said line with the Westerly prolongation of the Northerly line of that certain parcel of land known as Lot #107 of the San Jose Water Works - Trap No. 34 of San Jose Water Works Land" recorded in Book Q of Maps, Page 37, Santa Clara County Records; Thence, Easterly along the said Westerly prolongation of said Northerly line of said Lot #107 of the San Jose Water Works and further Easterly along the Northerly line of said San Jose Water Works Lot #107 to the point of intersection of said lute with the Westerly line of Lot 9, as said Lot is shown upon that certain map entitled "Buena Vista Heights", which Map was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on June 6, 1927, in Book 5 of Maps, at Page 18, Records of said County; Thence, Southerly along the Easterly line of said San Jose Water Works Lot #107 and along the Westerly lines of Lots 9 and 13 of said Buena Vista Heights Subdivision to the Southeast corner of said San Jose Water Works Lot #107, said point being also a point in the Southerly line of said hereinbefore mentioned Buena Vista Heights Subdivision; Thence, Easterly along the Southerly line of said Buena Vista Heights Subdivision to the point of intersection of said line with the Southerly prolongation of the Westerly line of Lot 10 of said Buena Vista Heights Subdivision; 0 6 Thence, Northerly along the said Southerly prolongation of said Westerly line of said Lot 10 Buena Vista Heights Subdivision and Northerly along the Westerly line of said Lot 10, Buena Vista Heights and further Northerly along the Northerly prolongation of said Westerly line of said Lot 10, Buena Vista Heights to the point of intersection of said line with the center line of Buena Vista Avenue, as the same now exists; Thence, Easterly along the various courses and distances of said center line of said Buena Vista Avenue to the point of inter- section of said line with the Northerly prolongation of the Easterly line of said hereinbefore mentioned Lot 10, Buena Vista Heights; Thence, Southerly along the Northerly prolongation of said Easterly line of said Lot 10, Buena Vista Heights and further Southerly along the Easterly line of said Lot 10, Buena Vista Heights and continuing further Southerly along the Southerly prolongation of of said Easterly line of said Lot 10 to the point/intersection of said line with the hereinbefore mentioned Southerly line of said Buena Vista Heights subdivision; Thence, Easterly following the various courses and distances of said Southerly line of said Buena Vista Heights subdivision and further Easterly along the Easterly prolongation of said Southerly line of said Buena Vista Heights subdivision to the point of inter- section of said line with the Easterly right-of-way line of the Southern Pacific Railroad Company, said point being also a point in the Town Limits line of the Town of Los Gatos; Thence, following the various courses and distances of the said Town Limits line of the Town of Los Gatos Southerly and Wester- ly to the point of beginning. w -2- ♦ s Introduced at a regular - meewing of the Town Council of the Town of Los Gatos, State of California, on the 1st day of May , 19 61 PASSED AND ADOPTED AS AN ORDINANCE OF THE TOWN OF LOS GATOS, CALIFORNIA,.
