Ord 0587-BRUCE TRACT - SHELBUANE ADDITION ANNEXATIONORDINANCE NO. AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED "BRUCE TRACT - SHELBUANE ADDITION ANNEXATION" TO THE TOWN OF LOS GATOS THE. TOWN COUNCIL OF THE TTYIN OF LOS GATOS DOES ORDAIN AS FOLLOWS: WHEREAS on the 20th day of March , 19 61 , the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the :Town of Los Gatos, said territory being therein designated as "Bruce Tract - Shelburne Addition An.nexatiop"and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and WHEREAS, on the 1st day of May , 19 61 , at the hour of 5:00 o'clock p.m. in the Los Gatos Council Chambers in the Town Hall of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexations, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page of Pages the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS., said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code Sections 35330 and 35314 inclusive have been fully complied with; NOW, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is hereby annexed to the :'own of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page of Pages 9 ! Beginning at the Northwest corner of that certain parcel of land as conveyed in the Deed from Mary Maxwell Brown to Dora Nordholz, Fred Nordholz and Florence D. Nordholz dated September 8, 1950, recorded September 8, 1950, in Book 2053 Official Records, page 403 Santa Clara County; Thence, following the exterior boundaries of said Nordholz parcel Southerly to the point of intersection of said line with the Northerly line of that certain parcel of land as conveyed in the Deed from Edgar J. Thompson and Margaret J, Thompson to Ernest E. Barkely and Ethel Blanche Barkely dated August 8, 1945, recorded August 11, 1945, in-Book 1288 Official Records, Page 41, Santa Clara County; Thence following the exterior boundaries of said Barkely parcel Westerly and Southerly to the point of intersection of said line with the Northerly line of that certain parcel of land as conveyed in the Deed from Alice J. Bruce to H,.J, Fanger and Violet Fanger dated April 4, 1946, recorded April 23, 1946, in Book 1351 Official Records, Page 64, Santa Clara County; Thence, following the Westerly line of said Fanger parcel South- erly to the point of intersection of said line with the Northerly line of Bruce Avenue, as the same now exists; Thence, Westerly along the Northerly line of said Bruce Avenue,;: as the same now exists, to the point of intersection of said line with the Northerly prolongation of the Westerly line of that certain parcel of land as conveyed in the Deed from Elizabeth M. Cecil to John T. Ricketts and Betty Lou Ricketts dated November 14, 1956, recorded November 19, 1956, in Book 3662 Official Records, Page 154, Santa Clara County; Thence, Southerly along the Northerly prolongation of said Westerly line of said Ricketts parcel and further Southerly along said Westerly line of said Ricketts parcel to the Southwest corner thereof, said point being in the Town Limits line of the Town of Los Gatos; Thence, following on and along the Town Limits line of the Town of Los Gatos Easterly to the point of intersection of said line with the Westerly right-of-way line of the Southern Pacific Railroad Company; - l - F 0 0 Thence, following the various courses and distances of the Westerly right-of-way line of the Southern Pacific Railroad Company generally Northerly to the point of intersection of said line with the center line of Shelburne Way, as the same now exists; Thence, Westerly along said center line of said Shelburne Way and further Westerly along the Westerly prolongation of said center line of said Shelburne Way to the point of intersection of said line with the Westerly line of Santa Clara-Los Gatos Road, as the same now exists; Thence, following the various courses and distances of said _...-,Westerly line of said Santa Clara-Los Gatos Road Southerly to the point of intersection of said line with the Northerly line of the hereinbef ore mentioned Nordholz parcel; Thence, Westerly along the Northerly line of said Nordholz parcel to the point of beginning. - 2 - Introduced at a - Regular - : 7' meeting of the Town Council of the Town of Los Carlos, State of California, on the 1st day of May , 19 61 PASSED AND ADOPTED AS AN OHDINAHCE OF THE TOWN OF DOS GATOS, CALIFORNIA, AT A Continued Regular MEETING OF THE TOWN COUNCIL, HELD JN THE 8th DAY OF Nay 1961 .
