AN ORDINANCE APPROVING THE ANNEzXATION OF CERTAIN
UNINHABITED TERRITORY, DESIGNATED
ORTHEAST :NUMBER NINE ANNEXATION"
TO THE TOW OF LOS GATOS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES MAIN
AS FOLLOWS:
WHEREAS on the 20thday of February , 19 61 , the Council
of the Town of Los Gatos did pass and adopt a Resolution giving
notice of the proposal to annex certain uninhabited territory to the
on of Los Gatos, said territory being therein designated as
"Northeast Number Nine Annexation?" , and said action being
taken by the Council of said Town as the legislative bony of the
Town pursuant to a written petition therefore, said Resolution
describing the boundaries of the territory so proposed to be
annexed to said Town; and
WHEREAS, said Resolution did contain a notice of the
day, hour and place when and where the said Council of said Town
would hear protests made by any person owning real property with-
in the territory proposed to be annexed, the time of said hearing
being not less than twenty nor more than sixty slays from the date
of the passage of said Resolution; and
WHEREAS, on the 3rd day of April - , 19 61 ,
at the hour of 8:00 o'clock p.m. in the Los Gatos Council
Chambers in the Town Hall of the Town of Los Gatos, County of
Santa Clara, State of California, said time and place being the
day, hour and place fixed in said Resolution for hearing protests
to said annexation, the said Council of said Town did hear and
pass upon all protests made to said proposed annexation and did
determine that no protests to said proposed annexation have been
made by or on behalf of the owners of one-half of the value of
the territory proposed to be annexed as shown by the equalized
roll, nor by public and private owners of equal to one-half of

the value of the territory proposed to be annexed as determined by
said legislative body; and
WHEREAS,, said territory is contiguous to the Town of
Los Gatos, and is uninhabited territory in the County of Santa
Clara, and all of the procedural requirements of the annexation of
Uninhabited Territory Act of 1939, particularly Government Code
Sections 35304 and 35314 inclusive have been fully complied with;
NOW, THEREFORE, the said Council of the Town of Los Gatos
does hereby approve the annexation of said territory, hereinafter
described, to the Town of Los Gatos and does hereby inrther ordain
that the said territory be and is hereby annexed to the mown of Los
Gatos.
That said territory, the annexation of which to the
Town of Los Gatos is hereby approved, is all that territory situate
in the County of Santa Clara, State of California, more particularly
described as follows:

B*ginning at the So utheasterly corner of Lot 5 of the"Nino
Tract", the map of which was filed for record in the office of the
Recorder of the County of Santa Clara, State of California, on
November 20, 1920, in Book Q of Maps, at Page 29, records of said
County, said point of beginning being also in the Town Limits line of
the Town of Los Gatos;
Thence, Westerly along the Southerly line of said Lot 5, Nino
Tract and along the Town Limits line of the Town of Los Gatos to the
point of intersection with the Westerly line of Lot 1, Block 1, of
the "Levi Hill Subdivision", the Map of which was filed for record
in the office of the Recorder of the County of Santa Clara, State of
California, on May 17, 1894, in Book H of Daps, at Page 71, records
of said County;
Thence, leaving the Town Limits line of the Town of Los Gatos
and following on and along the Westerly line of said Lot 1, Block 1,
Levi Hill Subdivision, Southerly to the point of intersection with
the Northerly line of that certain parcel of land conveyed to Joseph
L. Weltz, et ux, by Deed recorded May 4, 1945 in'Book 1249, Official
Records, Page 507, Santa Clara County Records;
Thence, following on and along the boundaries of said parcel of
Weltz, Southerly, along the Westerly line and Easterly along the
Southerly line, to the point of intersection with the Westerly line
of that certain parcel of land conveyed to Charles Mineo, et ux by
Deed recorded July 2, 1948 in Book 1650, Official Records, Page 397,
Santa Clara County Records;
Thence, following on and along the boundaries of said parcel of
land conveyed to Mineo, Southerly along the Westerly line of said
parcel to the point of intersection with the Northerly line of that
certain parcel of land conveyed to Natale Barbieri, et al, by heed
recorded August 13, 1948 in Book 1661, Official Records, Page 342;
Thence, following on and along the exterior boundaries of said
Barbieri parcel Southerly along the Westerly lime and Easterly along
the Southerly line and along the masterly prolongation of said
Southerly line to the point of intersection with the Westerly line
of that certain parcel of land conveyed to George J. Stepovich, et ux
by Deed recorded February 25, 1955 in Book 3095, Official Records,
Page 373;

Thence, following on and along the exterior boundaries of said
Stepovich parcel Easterly along the Southerly line and Northerly
along the Easterly line to the point of intersection with the
Southerly line of Lot 7 of the Kennedy Addition, the Map of which
was filed for record in the office of the Recorder of the County
of Santa Clara, State of California, on May 27, 1895, in Book H of
Maps, at Page 15, records of said County;
Thence, following the exterior boundaries of said Lot 7, Kennedy
Addition, Easterly and Northerly to the Northeast corner thereof,
said point being also a point in the Southeast corner of Lot 6, of
said Kennedy Addition;
Thence, following the exterior boundaries of said Lot 6,
ennedy Addition, Northerly and Westerly to the point of intersectic:
with the Easterly line of San Jose-:Los Gatos Road, as the same now
exists;
Thence, Northerly along the Easterly line of said San Jose-
Los Gatos Road to the point of intersection with the Town Limits
line of the Town of Los Gatos;
Thence, following on and along the said Town Limits line of
the Town of Los Gatos Westerly and Southerly to the point of
beginning.
