ORDINANCE OIZDERING THE VACATION OF A PORTION
OF GARDEN LANE IN THE TOWN OF LOS GATOS
THE, TOWN COUNCIL OF THE TOT),7N OF LOS GATOS ORDAINS
AS FOLLOWS:
SECTION 1. That the Town Council of the Town of
Los Gatos, on the first day of February 1960, passed a Peso-
lution declaring its intention to order the vacation of a
portion of Garden Lane, situated in the Town of Los Gatos,
County of Santa Clara, State of California, particularly de-
scribed as follows:
BEGINNING at a point in the Southeasterly line of
Garden Lane, (45.00) feet in width), as said Lane is
shown upon that certain Map entitled, "Tract
N6.1225 Highland Oaks", which Map was filed for
record in the office of the Recorder of the County
of Santa Clara; State of California, on March 27,
1957 in Book 7', of Maps, at pages 46 and 47, said
point being the most Northerly corner of that
certain parcel conveyed by Bernice Ryl.att to
Leonard C. McCammon, dated June 10, 1947, recorded
June 18, 1947 in Book 1442 Official Records, page
334, Santa Clara County Records, said point also
being distant along said Southeasterly line North
58° 34' 55" East 259.25 feet from the intersection
of said Southeasterly line with the Northwesterly
prolongation of the Northeasterly boundary of the
Elliott Subdivision, a Map of said Subdivision being
recorded in Book V of Maps, pages 18 and 19, Santa
Clara County Records; thence from said point of
beginning continuing along said Southeasterly line
of Garden. Lane, North 58 ° 34' 55" East 544.11 feet
to a corner formerly known as MWR.I; thence South
49° 07' 59" East 3.40 feet to the true point of
beginning of this description, said point being
distant Southeasterly 8.00 feet measured at right
angles from said Southeasterly line of Garden Lane;
thence from said true point of beginning South 49."07' 52P0
East 52.69 feet to the Northwesterly line of Parcel 2, as
said parcel is described in the Deed from Sibley, Inc,,
a corporation, et al, to Town of Los Gatos, a municipal
corporation, dated ;nine 2;,, 1959, recorded July c, 1959
in Book 4472 Official Records, page 73, Santa Clara
County Records; thence continuing along said North-
westerly line North 310 24' East 6.47 feet to the
beginning of a curve; thence Northerly and Westerly
along a curve to the left with a radius of 25.00 feet
through a central angle of 152° 49' 05S" an arc dis-
tance of 66.68 feet to a line parallel to and distant
8.00 feet from the Southeasterly line of Garden Lane;
thence parallel to said Southeasterly line South 58'34' 55"
West 10.37 feet to the true point of beginning, and being
a portion of the ;Rancho:'Rincona.da` de-:Los'Gatos, and being a
portion of that certain easement described in the deed from
Robert Walker to County of Santa Clara, recorded September
27, 1895 in Book 134 of Deeds, at page 133, Santa Clara
County Records.

SECTION 2. That the portion of said Garden
Lane in the Town of Los Gatos to be vacated, and the details
of said vacation, are particularly shown upon a map bearing
the legend:"plat to accompany request for abandonment of
Easementf. which map was by said Resolution approved
for the purpose of this proceeding, and was ordered filed
in the Office of the Town Clerk of the Town of Los Gatos;
and was marked "Filed January 14th, 1960`B; and which map
was in said Resolution referred to for particulars as to the
proposed vacation.
SECTION 3. That the Town Clerk of the Town of
Los Gatos caused said. Resolution to be published as
designated in said Resolution.
SECTION 4. That the Town Clerk of the Town of
Los Gatos caused to be posted conspicuously along the line
of the portion of Garden Lane proposed to be vacated,
Notices of Street Vacation in the form and manner required
by said Resolution.
SECTION 5. That proof of said publication is
evidenced by an Affidavit of Publication now on file in the
Office of he Town Clerk of the Town of Los Gatos.
SECTION 6. That proof of said posting is
evidenced by the Affidavit of the person posting said'
notices, which Affidavit sets forth the facts regarding such
posting and is now on file in the Office of the, Town Clerk..
of the Town of Los Gatos.
SECTION 7. That said Resolution fixed the 7th day
of March 1960, at the hour of 8:00 p.m. of said day,; in
the Council Chambers of the Town Hall, in the Town of Los
Gatos, as the time and place for hearing by the Town Council
of all persons interested in, or objecting to, the proposed
vacation.

SECTION S. That the matter of said proposed
vacation came on regularly for hearing before the Town
Council of the Town of Los at its regular meeting on the
7th day of March 1960, and at such hearing the said Town
Council heard the evidence offered by all persons interested
in said proposed vacation; and a full hearing thereon
having been had, the matter was submitted for determination.
SECTION 9. That the Town Council of the Town of
m Los Gatos finds and determines from all the evidence sub-
witted, that that portion of Garden Lane described in said
Resolution,; and herein'above more particularly described,
is unnecessary for present or prospective public-street
purposes; and said portion of Garden Lane is hereby ordered
vacated,, subject to and governed-,by the reservations and
exceptions contained in said Resolution of Intention dated
February 1, 1960,
SECTION 10: This Ordinance shall be published
in the "Los Gatos Times-Saratoga Observer", a newspaper of
general circulation, published and circulated in the Town of
Los Gatos, California; and the Town Clerk of the Town.of Los
Gatos shall cause a certified copy of this Ordinance, attested
by the Town Clerk under the Seal of the Town of Los G-itos,
to be recorded.in the Office of the County Recorder of the
County of Santa Clara, within which the Town of Los Gatos
is located.
SECTION 11. Introduced at a regular meeting of
the Town Council of the Town of Los Gatos on the 7th day
of March 1960.
