Ord 0521- ADOPTING BY REFERENCE AND MODIFYING ORDINANCE NO. NS-403 OF THE COUNTY OF SANTA CLARAORDINANCE NO. AN ORDINANCE ADOPTING BY REFERENCE AND MODIFYING ORDINANCE NO. NS-403 OF THE COUNTY OF SANTA CLARA ENTITLED B° AN ORDINANCE ADDING CHAPTER 3 TO TITLE 4 OF THE SANTA CLARA COUNTY ORDINANCE CODE AND REPEALING ARTICLES 1 AND 2 OF TITLE 6 OF THIS SAID CODE AND SECTIONS 3.1.26-12.1 THROUGH. 3.1.26-12.10 OF THE ADMINISTRATIVE CODE OF THE COUNTY OF SANTA CLARA AND REGULATING THE KEEPING AND LICENSING OF DOGS AND OTHER ANIMALS" AND PROVIDING FOR PENALTIES THE TOWN COUNCIL OF TIE TOWN OF LOS GATOS DOES ORDAIN A S FOLLOWS 3ECTI0N 1: (a) The Board of Supervisors of the County of Santa Clara having on March 23, 1959 passed and adopted Ordinance No. NS-433 providing for and regulating the keeping and licensing of dogs and other animals, which said ordinance has been published and printed as required by law, and not less than three copies thereof all certified to be true copies by the Town Clerk of the Town of Los Gatos having been for at least fifteen days preceding the public hearing on this ordinance and continuously since, and are now, and shall be kept on file in the office of the Town Clerk of the Town of Los Gatos for public inspection thereof; reference being hereby made to said ordinance for all the regulations, provisions, conditions, terms and requirements therein shown, and said regulations, provisions, conditions, terms and require- ments of said Ordinance No. NS-403 are, and each is, hereby adopted by reference and made a part hereof the same as if fully set forth in this ordinance, and are and each is by such reference adopted as sections of this ordinance; bearing the same numerical. section designations as appear in said Santa Clara County Ordinance with exceptions as are hereinafter set forth in Subsection "(b)", and as such are and each is adopted as and for an Ordinance of the Town of Los Gatos. (b) (1) therefrom. Sections 2, 4 and 5 are hereby omitted and deleted -1- (2) Thenever the word "County" or "Co." is used in Sections 4.3.1-7 44.3.1-11; 4.3.2-2; 4.3.2-3; 4.3.2-6; 4.3.2-3.1; 4.3.2-9; 4.3.2-10; 4.3.3-1, 4.3.3-4; 4.3.3-5, it shall be deemed to include the words "Tovtn of Los Gatos". 3ECTION 2: The word °tperson" as used in this ordinance includes any individuals, firm, association,.organization, partnership, company and corporation,, whether acting as principal agent _-..gr-officer, servant or employee for himself, itself or for any other person. SECTION 3 The words "Director" and "Director of Public Health" as used in this ordinance is the duly appointed Director of Public Health of the County of Santa Clara. SECTION 4: The words "Rabies Control Operator" as used in this ordinance shall mean the duly appointed Rabies Control Operator of the County of Santa Clara, his assistants or deputies. SECTION 5: It shall; be unlawful for'any person owning, having an interest in, harboring, or having charge, care, control, custody, or possession of any dog to cause or permit such dog to he in or upon any public street, alley, or other public place, or in or upon any unenclosed lot or premises, unless such dog be securely confined by a strong leash, securely and continuously held by the person owning, having an interest in, harboring, or having charge, care, control, custody, or possession of such dog, or unless such dog be confined within an automobile. SECTION E:,: No person owning, or having care, charge, custody or control of any dog shall cause, permit or allow the same to go to, nor shall it be taken to, or into a place where food is handled, prepared, served or sold, nor in any pudic or private school building or -2~- • school ground in the incorporated area of the Town of Los Gatos. SECTION 7 It shall be unlawful for any person to have, maintain or harbor within the Town of Los Gatos more than two dogs. I1:- both of said dogs be females, then one of said dogs shall be rendered neuter. SECTION 61': The Town Council shall have the power to establish rules and regulations by resolution consistent with the provisions o: this ordinance, and to enter into written contracts with the County of Santa Clara for the purpose of enforcement and administra- tion of this ordinance. SECTION 9: Any person, firm or corporation, or otherwise, violating or causing the violation of any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the County jail of the County of Santa Clara for a term not exceeding six (f) months, or by both such fine and imprisonment. Such person, f-r_rm or corporation shall be deemed guilty of a separate offense for each and every day during any portion of which any violation of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable as herein provided. SECTION 10 It is the intention of the Town Council of the Town of Los Gatos that each separate provision of this Ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the Town Council of the Toren of Los Gatos that if any provision of this Ordinance be declared invalid, all other provisions thereof shall remain valid and enforceable. SECTION 11: This Guy~din,.ance is herelf-Dy declared to ~ an urgency measure and shall take effect i_mmedi_atel-V and t'ee following _i_s a declaration of =~C:> constituting the urgency. The Department of Health of the State of California has declared the County of Santa Clara, agate o-F- Cali_forn i a to be a rabies endemic area; the County of an't.a Clara is better equipped t.o control dogs and stray animals within the Tc;TiTn of Los Gatos and to make proper provisions for diseased., vicious or dead animals, than the Town of Los Gatos, and the County of Santa Clara lha agreed to perform this service for and on behalf of the ToT,7n of Los Gatos; that legislation is immediately required, and this ordinance is therefore passed for the immediate preservation of the public health and safety.
