Ord 0464-ADDING TO SAID ORDINANCE NO. 3 SECTION 3.00 THEREOFORDINANCE NO. 464 BEING AN ORDINANCE OF THE TOWN OF LOS GATOS, AMENDING ORDINANCE NO. 392 DESIGNATED AS THE ZONING ORDINANCE OF SAID TOWN BY AMENDING SECTION 3.00 THEREOF:°AND BY ADDING TO SAID ORDINANCE NO. 392 A NEW SECTION TO BE KNOWN AS SECTION 27.00, WHICH SECTION ESTABLISHES A NEW-ZONING DISTRICT AND PRESCRIBES USES OF LAND AND BUILDINGS AND OTHER.REGULATIONS REQUIRED IN SAID DISTRICT: ADOPTING THE PRO- VISIONS OF CERTAIN PRIMARY CODES AND STANDARDS BY REFERENCE, WHICH SAID CODES AND STANDARDS ARE THE AMERICAN STANDARD SOUND LEVEL METERS FOR MEASUREMENT OF NOISE AND OTHER SOUNDS, 224.3: 1944, AMERICAN STANDARDS ASSOCIATION INC., NEW YORK, N. Y., AND `AMERICAN STANDARD SPECIFICATION FOR ANOiCTAVE-BAND FILTER SET FOR THE ANALYSIS OF NOISE AND OTHER SOUND, 224.10 - 1953, AMERICAN STANDARDS ASSOCIATION, INC., THE STANDARD RINGLEMANN SMOKE CHART AS ISSUED BY THE UNITED STATES BUREAU OF MINES FORTHE PURPOSE OF MEASURING THE DENSITY OF SMOKE, DUST AND OTHER AIR POLLUTING ELEMENTS, THE STANDARDS OF THE MANUFACTURING CHEMISTS' ASSOCIATION, INC., PARTICULARLY CHAPTER 5 THEREOF ENTITLED "AIR POLLUTION ABATEMENT MANUAL" FOR THE MEASUREMENT OF ODOROUS GASES AND ODOROUS MATTERS The Town Council of the Town of Los Gatos does ordain as follows: SECTION ONE. Section 3.00, DISTRICTS, of Ordinance No. 392 is hereby repealed. SECTION TWO. The following new sections are hereby added to Ordinance No. 392: Section 27.00 11CM11 CONTROLLED MkNUFACTURING DISTRICT Section 27.01 The following regulations shall apply in the IICMII Controlled. Manufacturing District: Section 27..02 USE: No building, structure or land shall be used and no building or structure shall be hereafter erected, structurally altered or enlarged, except for the following uses: Section 27.03 Administrative, executive and, financial offices Air conditioning, manufacture and sale Aircraft parts, manufacture and sale Automobile parts, manufacture and sale Awning manufacture and sale, cloth, metal, wood or plastic Broom manufacture and sale Bottling works and syrup manufact- ure and sale Confection manufacture and sale Carting, express, hauling or storage Clothing and dry goods manufacture and sale Crop and tree farming, as the same existed at the time of the adoption of this ordinance Electrical and electronic parts, products and appliances and sale of same Electrical and neon sign, manufact- ure and sale - 2- • Envelope manufacture and sale Fixture manufacture and sale Food and Beverage sale Furniture manufacture and sale Hardware, manufacture and sale Household appliances, manufacture and sale Ice cream manufacture and sale Knit good manufacture and sale Laboratories, experimental, film or testing Leather products sale Looseleaf book manufacture and sale Mattress factory and sale - renov- ating where dust precipitating equipment is used Metal products, manufacture and sale Millinery manufacture and sale Office equipment and supply, manufacture and sale Optical goods manufacture and sale Paper products and paper box products sale Pharmaceutical manufacture and sale Plastic products, molding, casting, and shaping Pool car distribution warehouse Professional, research and engineering offices Publishing, printing, engraving and lithographing Restaurants, subject to the securing of a conditional use permit in accordance with the procedure specified in Section 18.00 of this ordinance. Rug and carpet manufacture and sale-- cleaning, if dust-proof cleaning rooms in which dust catching, washing and scouring equipment are provided Seed, sale -3- Shoe and boot manufacture, and sale excluding any tanning operation Storage battery sale Team tracks and unloading docks, railroads Tires and accessories, sale Tire retreading and recapping and sale Tool manufacture and sale Venetian blind manufacture and sale Warehousing and sales office Wood products sale Other uses similar to the above if first approved as provided in Section 15.01.1 of Ordinance No. 392, as amended Section 27.01 DEFINITION OF SALE: The term sale as used in the foregoing section shall be limited to: (1) The wholesale of articles manufactured on the premises. (2) Sales to the ultimate consumer of articles manufactured on the premises to customer's order. Retail businesses, that is, those businesses engaged in the purchase of articles at wholesale for resale at retail are prohibited and excluded.. Section 27.05 AUTOMOBILE PARKING ADD LOADING AREAS Automobile parking and loading shall be provided for as follows: (a) Parking spaces shall b e provided on the lot for all vehicular traffic'enteritg the lat. (b) All parking, loading and unloading shall take place in side or rear yards. s (c) Adequate areas shall be provided on the lot for all loading and unloading operations. (d) There shall be no parking of vehtcies in any front yard without approval of a plan therefor by the Planning Commission. Section 27.06 HEIGHT: Maximum building height permitted: 30 feet. Section 27.06.1 Building heights greater than 30 feet may be permitted upon the securing of a use permit in accordance with the procedure provided in Section 1$.00 of this ordinance. Section 27.07 APNEA Section 27.08 No building or structure or the enlarge- ment of any building or structure shall be hereafter permitted unless the following yards and lot areas are provided and maintained in connection with such building, structure, or enlargement.. Section 27.09 FRONT YARD: There shall be a front yard of not less than twenty-five (25) feet; provided however that an additional one foot in depth shall be added to the minimum of twenty-five feet for each one foot in height that the main building exceeds twenty (20) .feet. Section 27.09.,1 All front yards are to be landscaped and maintained in a neat and attractive condition at all tunes. This is not intended to prohibit the construction of necessary driveways, which also are to be maintained in a neat and attractive condition at all times, Section 27.10 SIDE YARDS: Side yards shall be a minimum of twenty-five (25) feet in width.. Section 27,10.1 Where a lot has its side yard adjacent to a street the Planning Commission may designate such additional landscaping and set back requirements necessary to maintain the area in a uniform character. Section 27.11 REAR YARD: There shall be a rear yard of nqt less than ten (10) feet. Section 27..31.1 inhere a lot has its rear yard adjacent to a street the Planning Commission may designate such additional -5- > I 4 landscaping and set back requirements as are necessary o maintain the area in a uniform character. Section 27012 MAXIMUM BUILDING COVERAGE Section 27.13 The ground floor area of all buildings constructed on any one lot shall not exceed forty percent (40%) of the total area of the lot* Section 27.14 SIGNS Section 27015 Signs identifying the name of the company and products produced by the company shall be permitted if attached to the main building, except as follows: (a) No sign shall extend above the cornice line of the building. (b) All signs are to be attached parallel to the wall of the building to which they are attached. (c) Signs other than those attached to the building are to be first approved by the Planning Commission in the manner provided in Section 14.00 (a). (d) Small directional signs and other signs necessary to the functioning of the plant are permitted without approval. Section 27.16 FENCING Section 27.1' Fencing of any kind, properly maintained, and having a uniform and durable character shall be permitted.. No fencing of front yard areas shall be permitted. Section 27.18 TYPE OF CONSTRUCTION Section 27019 All main buildings shall be of concrete or masonry construction, .Office buildings, or office wings attached to main buildings may be constructed of other materials, if first approved by the Planning Commission, in accordance with the provisions of Section 14.00. Section 27.20 MATERIAL STORAGE Section 27.21 Storage of raw, in process or finished material and supplies, and of waste materials shall be maintained at all times in an enclosed building. -6- Section 27.50 PERFORMANCE STANDARDS Section 27,51 FIRE AND EXPLOSION HAZARDS Section 27.52 All activities involving, and all storage of, inflammable and explosive materials shall be provided with adequate safety devices against the hazard of fire and explosion and adequate fire-fighting and fire-supression equip- ment and devices standard in industry. All incineration is prohibited. Section 27.53 RADIOACTIVITY OR ELECTRICAL DISTURBANCE Section 27.54 Devices which radiate radio-frequency energy shall be so operated as not to cause interference with any activity carried on beyond the boundary line of the property upon which the device is located. Radio-frequency energy is electro-magnetic energy at any frequency in the radio spectrum between 10 kilocycles and 3 million megacycles. Section 27.55 NOISE Section 27.56 The maximum sound pressure level radiated by any use or facility when measured at the boundary line of the property on which sound is generated shall not exceed the values shown in the following table: Octave Band Range Sound Pressure Level in in cvcles per Second Decibl.es 0.0002 dyne/cm2 Below 75 72 75 - 150 67 150 - 300 59 300 - 600 52 600 1200 46 1200 - 2100 40 2100 - 4800 34 Above 4800 32 Section 27,57 The sound pressure level shall be measured with a sound level meter and associated octave band analyzer conforming to standards prescribed by the American Standards Association. "American Standards Sound Level Meters for Measurement of Noise and Other Sounds, 224.3 - 1944, American Standards Association, Inc., New York, N.Y., and American Standards Specifications for an Octave-Band Filter'-set-for the Analysis of Noise and Other Sound, 224.10 - 1953, American -7 Standards Association, Inc., New York, N.Y.,`shall be used,. and the sage are adopted. herewith' b'y reference with the 'same effect as if. herein set forth in full. Section 27.58 VIBRATION Section 27.59 No vibration shall be permitted so as to cause a noticeable tremor at the lot line. Section 27.60 SMOKE Section 27.61 No emission shall be permitted at any point, from any chimney or otherwise, of visable grey smoke of a shade equal to or darker than No. 1 on the Standard "Ringlemann Smoke Chart, Information Circular 7718, as issued by the United States Bureau of Mines, August, 1955, except that visable grey smoke of a shade equal to No. 1 on said chart may be emitted for four (4) minutes in any thirty (30) minutes. That said Standard Ringlemann Smoke Chart, Information Circular 7718, as issued by the United States Bureau of Mines, August, 1955, is hereby adopted by reference with the same force and effect as if herein more fully set forth. Section 27.62 These provisions applicable to visible grey smoke shall also apply to visible smoke of a different color but with an apparently equivalent opacity. Section 27.63 ODORS Section 27.64 No emission shall be permitted of odorous gases or other odorous matter in quantities which exceed those proportions shown in Table III, "Odor Thresholds", in Chapter 5, "Air Pollution Abatement Manual", copyright 1951 by Manufacturing Chemists' Association, Inc., Washington, D.C..A which said manual and table are herewith made a part hereof and adopted by reference as if herein more fully set forth, Section 27.65 FLY ASH, DUST, FUMES, VAPORS, GASES AND OTHER FORMS OF AIR POLLUTION Section 27.66 No emission shall be permitted which causes any damage to health, to animals, vegetation, or E E other form of property, or which causes soiling, at or beyond the property line of the property where the emission is produced,, Section 27.67 GLARE Section 27.68 No direct or reflected glare, whether produced by floodlight, high temperature processes such as combustion or welding or other processes so as to be visible from any boundary line of property on which the same is produced shall be permitted. Sky - reflected glare from buildings or portions thereof shall be so controlled by such reasonable means as are practical to the end that the said sky - reflected glare Vill not inconvenience or annoy persons or interfere with the use and enjoyment of property in and about the area where it occurs, Section 27.69 CODES AND STANDARDS ADOPTED BY REFERENCE: The Town Council of Town of Los Gatos does hereby adopt the following enumerated standards and codes for the control and regulation of noise, smoke, odors, and emissions related thereto. l.. All the standards and provisions for the measurement of sound pressure levels prescribed by the American Standards Association including American Standards Sound Level Meters for Measurement of Noise and other sounds, 224.3 - 1944, American Standards Association Inc., New York, N.Y., and American Standards Specifications for an Octave-Band Filter Set for the analysis of Noise and other Sound, 224.10 - 1953, American Standards Association, Inc.$ (three copies of which have been filed for use and examination by the public in the office of the Town Clerk) are hereby referred to and are hereby adopted and made a part hereof as if fully set forth in-this ordinance, 2.. All the standards and provisions for the measurement and control of smoke prescribed by the Standard Ringlemann Smoke Chart, Information Circular 7718 as issued by the United States Bureau of Mines, United States Department of the Interior, August, 1955 (three copies of which have been filed for use and examination by the public in the office of the Town Clerk) are hereby adopted and made a part hereof as if fully set forth in this ordinance. 3. All the standards and provisions for the measurement a4 control of odorous gases or other odorous matters, and particularly Table III entitled "Odor Thresholds" in Chapter 5., "Air Pollution Abatement Manual", Copyright 1951 by Manufacturing Chemistst Association, Inc.., Washington, D.C., (three copies of which have been filed for use and examination by the public in the office of the Town Clerk) are hereby referred to and are hereby adopted and made a part hereof, the same as if fully set forth in this ordinance. 0 0 SECTION FOUR* Introduced.at a regular meeting of the Town Council of the Town of Los: Gatos, State of California, held on the day of ' 1958.
