Ord 0463-KENNEDY ROAD NUMBER THREE ANNEXATION0 0 , ORDINANCE NO. 4V,? AN ORDINANCE APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED "KENTEDY ROAD NUMBER THREE ANNEXATION" TO THE TOWN OF LOS GATOS. THE TOWN COUNCIL OF THE TOfili OF LOS GATOS DOES ORDAIN AS FOLLOWS, WHEREAS, on the 3rd day of February, 1958, the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the Town of Los Gatos, said territory being therein designated as "KENNEDY' ROAD NUMBER THREE ANNEXATION'', and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing: the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution slid contain a notice of the day, hour and.place when and where the said Council of said Town. Would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and WHEREAS, on the 17th-day of March 1958, at the hour of 7:30 o'clock p.m. in the Los Gatos Town. Council Chambers in the Town Hall of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Torn did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the last equalized roll, nor by public and private owners of equal to one-half of the value of the territory proposed to be annexed as determined by said legislative body; and • E WHEIMASI said territory is contiguous to the Torn of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code sections 35300 to 35314 inclusive have been fully complied with; i OW., TIEREFORE, the said Council of the Torn of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain: that the said territory be and is hereby annexed to the Town of Los Gatos. That said territory, the annexations of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more Page -of -Pages particularly described as follows. ® a Beginning at the point. of intersection of the Southwesterly line of Kennedy Road, 40 feet wide, with the `Iorthzvesterly line of the Subdivision of Crescent Hill, the Tap of which subdivision was filed.for record in the office of the Recorder of the County of Santa Clara, State of California on July 23, 1929 in Book T'Xsr of Maps, at pages 4,6 and 47, said point of beginning being an angle point in the Town Limits line of the Totim of Los Gatos; thence said following/Town Limits line Northwesterly along the various courses and distances of the Southwesterly line of said Kennedy Road to an angle,point where the Westerly line of said Kennedy. Road bears North- easterly; thence following said Town. Limits line Torth east erly along said Westerly line of said Kennedy Road to an angle point where the Westerly line becomes the Southerly line of said Ken-aedy road; thence following said Town Limits line further Northeasterly along the North- easterly prolongation of the last named course to the Northerly line of said Kennedy Toad, said point being also the point of inter-- section of the NTortherly line of Kennedy Road with the Northerly line of Crescent Avenue, the latter being 40 feet in width; thence following said Town Limits line Northeasterly and Easterly along the Northerly line of said Crescent Avenue to the intersection with the 141orthwwesterly line of that certain parcel of land described in the Deed from Margaret D. Mixer to A. L. Vince and Grace D. Vince, as joint tenants, dated January 25, 1941 and recorded January 27, 1941 in Book 1021 of Official Records, page 150, Santa Clara County Records; thence Northeasterly along said Northwesterly line of said parcel to the most Northerly corner of said parcel; thence following said Town Limits line Easterly along the Northerly lire of said parcel to the most Northeasterly corner of said parcel; thence Southerly along the Easterly line of said parcel, to the most South- easterly corner of said parcel, being also a point on the Northerly line of said Crescent Avenue; thence following said Town Limits line Southeasterly along the various courses and distances of the North- easterly line of said Crescent Avenue to the point of intersection thereof with the Northerly line of that certain 2..03" acre parcel of -1- land conveyed by Carlo A. Picardo, et ux' to-Adolf Aymer, et ux, by Deed dated September 2, 1931 and recorded September 5, 1931 in Book 530 of Official Records, at page 494, Santa Clara County Records; thence following said Town Limits of the Town of Los Gatos and r j.uining along said Northerly line of Aymer Easterly to the Horth easterly corner of said last named parcel, thence leaving the Town Limits line of the Town of Los Gatos and running along the Easterly and Southerly lines of said last named parcel Southerly and Westerly to the point of intersection with the Portheasterly line of Crescent Avenue; running thence along the Northeasterly and Easterly lines of Crescent Avenue, Southeasterly and Southerly to the point of intersection of said Easterly line of Crescent Avenue with the Easterly prolongation of the Southerly line of Kennedy Road; thence running along the Masterly prolongation of the Southerly line of Kennedy Road, and along the Southerly, 'sester.ly and Southwesterly lines of Kennedy Road, Westerly, Northerly and Northwesterly to the point of beginning. -2- Intreduced'at a regular meeting of the Town Council in the Town of Los Gatos, State of California, on the _zz day of March , 1958.
