,SECTION 1. The Town Council of the Town of Los
Gatos , on the 4th day of March, 1957, by Resolution referred
the matter of the vacation of a portion of Garden Lane IN THE
TOWN OF LOS GATOS , to the Planning :Commission for its Report
and Recommendation; that thereafter, on the 3rad day of April,
1957, after due notice of the time and place of hearing,
published as required by law, and at a public hearing thereon,
the Planning Commission recommended the vacation of a portion
of Garden Lane, hereinafter particularly described. That the report
and recommendation of the Planning Commission of the Town of
Los Gatos is on file with the Town Clerk.
SECTION 2. That the Town Council of the Town
of Los Gatos, on the 22nd day of April, 1957, passed Ordinance
Nov 427 declaring its intention to order the vacation of a'
portion of said Garden Lane, particularly described as follows;
A parcel of land situate in the Town of Los
Gatos, County of Santa Clara, State of California,
being more particularly described as follows;
BEGINNING at a point in the Westerly line of
Lot 49 as said Lot is shown on a Map of Tract
#1233, Foothill Farms, recorded in Book 76 of Maps
at Pages 30 acid 31, Santa Clara County Official
Records, said point being at the' intersection of
Said Westerly line with a Northeasterly' line of
the lands of the State of California; thence fror
said point of beginning South 700 15, 20" East
alone} the line dividin : the lands of the State of
California and said LoL 49 and alone the Soutia-
easterly prolongation of said line 347.55 feet
to the most Easterly lire of Lot 29 as said Lot
is shown on Tract #1225, Highland Oaks (unrecorded);
thence Southeasterly along a curve to the left with
a radius of 40 feet (a tangentto the curve at this
point having a bearing of Nor~h 120 331 50m East)
through a central angle of 53 52r 10" an arc
distance of 37.61 feet to the Southerly line of
Garden Lane as said Lane is shown on a Map
of the Walker Tract Sub. recorded in Book F
of.Maps at Page 40, Santa Clara County Records;
thence along the Southerly line of said Lane
North 70 15t 20f1 %lest 335.84 feet to an inter
section with the Southeasterly prolongation of
the herein above mentioned Westerly line of said
Lot 49; thence along said Westerly line North 270
081 20" West 43.89 feet to the point of beginning
and being a portion of Garden Lane 30 feet wide
as shown on the herein abovementioned Map of the
Walker Tract Subdivision.
SECTION 3. That the portion of said Garden Lane
in the Town of Los Gatos to be vacated, and the details of said
vacation, are particularly shown upon a map bearing the legend;
"Proposed vacation of a portion of Garden Lane", which map was
by said Ordinance No. 42.7 approved for the purpose of this
proceeding, and was ordered filed in the office of the Town
Clerk of the Town of Los Gatos , and wa,s marked "filed March
4th, 1957"; and which map was in said Ordinance No. 427
referred to for particulars as to the proposed vacation.
Ordinances or parts of Ordinances in conflict with this
Ordinance are hereby repealed.
SECTION 4. That the Town Clerk of the Town of
Los Gatos caused said Ordinance No., 427 to be published as
designated in said Ordinance.
SECTION 5. Than the Town Clerk of the Town of
Los Gatos caused to be posted conspicuously along the line of
the portion of Garden Lane proposed to be vacated, Notices of
Street Vacation in the form and manner required by said Ordin-
ance No. 427.
SECTION 6. That proof of said publication is
evidenced by an Affidavit of Publication now on file in the
office of the Town Clerk of the Town of Los Gatos.
SECTION 7. That proof of said posting is evidenced
by the Affidavit of the person posting said notices, which
Affidavit sets forth the facts regarding such posting and is
now on file in the Office of the Town Clerk of the Town of
Los Gatos.
SECTION 8. That said ordinance No. 4.27 fixed the
3rd day of June, 1957, at the hour of 7.30 P.m. of said day,
in the Council Chambers at the Town Nall, in the Town of Los
Gatos, as the time and place for hearing by the Town Council
of all persons interested in, or objecting to, the proposed
vacation.
SECTION 9. That the matter of said proposed
vacation came on regularly for hearing before the Town
Council of the Town of Los Gatos at its regular meeting on the
3rd day of June, 1957, and was thereafter duly and regularly
continued to October 21, 1957, and at such hearing the said
Town Council heard the evidence offered by all persons
interested in said proposed vacation; and a full hearing
thereon having been had, the matter was submitted for determina-
-SECTION 10. That the Town Council of the Town of
Los Gatos finds and determines from all the evidence sub-
that that portion of Garden Lane described in said
Ordinance No. 427, and hereinabove more particularly described,
is unnecessary for present or prospective public-street
purposes; and said portion of Garden Lane is hereby ordered
SECTION 11. This Ordinance shall be published
in the "Los Gatos Times-Saratoga observer," a newspaper of
general circulation, published and circulated in the Town of
Los Gatos, California; and the Town Clerk of the Town of Los
Gatos shall cause a certified copy of this Ordinance, attested
by the Town Clerk under the weal of the Town of Los Gatos, to
be recorded in the Office of the County Recorder of the County
of Santa Clara:, within which the Town of Los Gatos is located.
SECTION 12. Introduced at a regular meeting of
the Town of Los Gatos on the .7/,°` day of October , 1957.
