J77 AN URGENCY ORDINANCE SUSPENDING IN PART ORDINANCE NO. 351 OF THE TOWN OF LOS G ATOS ENTITLED: "Al ORDINANCE REGULATING THE SALE AND USE OF FIREAR14IS, EXPLOSIVES AND AIR RIFLES, PROVIDING FOR THE DISPOSAL THEREOF THE TGTN COUNCIL OF THE TO"WIN OF LOS GATOS DOES ORDAIN AS FOLLOvuYS Section 1. That Ordinance No. 351 entitled "An Ordinance Regulating the Sale and Use of Firearms, Explosives.and Air Rifles, Providing for the Disposal Thereof" passed and adopted by the Town Council of the Town of Los Gatos on January 19, 1953 be suspended in part as follows: 1. Regularly licensed blasting contractors shall be excepted and excluded from the following provisions of Section 1 of `Ordinance No. 351 wherein said Section 1 makes it unlawful for any person to, at any time, fire or cause to be fired or exploded any combustible or explosive device or preparation or fire-works of any kind whatsoever by whatever name known, limited however, to the California State Highway right-of-way situated south of the East Main and West Main Street Bridge, thus making-it lawful for said licensed blasting contractors to blast rock formations and outcroppings occurring within the limits of said right-of-way; nothing herein contained authorizes any other act prohibited by Ordinance No. 351 of the Town of. Los Gatos, or any other ordinance of the Town of Los Gatos, or laws or regulations of the State of California; and provided further, that said blasting operation shall be conducted only between the hours of eight o'clock A.M. and five o'clock P.M. of any day,.excluding Saturdays and Sundays. Section 2. This ordinance is hereby declared to be an urgency measure and necessary for the immediate preservation of the public peace, health and safety, and shall take effect and be in full force forthwith. The following is a statement of the facts constituting. such urgency 6 0 I,I The Town Council finds that the L. C. SMITH COMPANY, Contractor has attempted to remove said rock formations and outcroppings by usual methods short of using jack hammers or by blasting and has been unable to remove said rock formations and outcroppings; that by use of crews using a jack hammer, the noise is deafening and will require an indefinite number of days and nights for said operation, which would, because of said noise disturb the peace, quiet, comfort and health of the citizens of the Town of Los Gatos in the vicinity of said California State Highway right-of-way.
