ORDINANCE ORDERING THE VACATION OF A
PORTION OF WEISER ALLEY IN THE TOWN
OF LO GATO .
THE TO,FTN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLMIS:
Section 1. The Town Council of the Town of Los Gatos,
on the 7th day of June, 1954, by Resolution referred the matter
:of the vacation of a portion of WEISER ALLEY in the Town of Los
Gatos, to the Planning Commission for. its Report and Recommenda-
tion; that thereafter, on the 25th day of June, 1954, after due
notice of the time and place of hearing, published as required
by law, and at a public hearing thereon, the Planning Commission
recommended the vacation of a portion of WEISER ALLEY, hereinafter
particularly described. That the Report and recommendation of
the Planning Commission of the Town of Los Gatos is on file with.
the Town Clerk,
Section

That
the
Town Council
of the
Town of
Los
Gatos, on the
12th
day
of
July •
1954,
passed
Ordinance
NO. 364 declaring its intention to order the vacation of a por-
tion of said WEISER ALLEY, particularly described as follows:
All of that portion of a certain twelve-foot
(12 ft.) alley lying between Lot 21 and Lots
1, 2, and 3, as the same is shown upon a
Map entitled "Subdivision of a part of the
land of W. C. Shore, Esp.. in the Town of
Los Gatos, California", filed May 27, 1889,
in Book "D" of Maps, at page 109, Official
Records of Santa Clara County; all lying
and being Southeasterly of the Southwesterly
prolongation of the Northwesterly line of
said Lot 3, as said Lot is shown upon said
Map.
Section 3. That the portion of said alley to be vacated,
and the details of said vacation, are particularly shown upon a
map bearing the legend: "Proposed Vacation of a Portion of Weiser
,1
Alley", which map was by said Ordinance No. 364 approved for the
purpose of this proceeding, and was ordered filed in the Office
of the Town Clerk of the Town of Los Gatos, and was marked
"!filed July 12, 1954"; and which map was in said Ordinance No.
364 referred to for particulars as to the proposed vacation.
All Ordinances or parts of Ordinances in conflict with this
Ordinance are hereby repealed.
Section 4. That the Town Clerk of the Town of Los Gatos
caused the said Ordinance No. 364 to be published as designated
in said Ordinance.
Section 5. That the Town Clerk of the Town of Los Gatos
caused to be posted conspiciously along the line of the portion
of the alley proposed to be vacated, Notices of Street Vacation
in the form and manner required by said Ordinance No. 364.
Section 6. That proof of said publication is evidenced
by an Affidavit of Publication now on file in the Office of the
Town Clerk of the Town of Los Gatos.
Section 7. That proof of said posting is evidenced by
the Affidavit of the person posting said notices, which Affidavit
sets forth the facts regarding such posting and is now on file
in the Office of the Town Clerk of the Town of Los Gatos.
Section 8. That said Ordinance Nos 364 fixed the 6th
day of September, 1954, at the hour of eight o'clock, P.M. of
said day, in the Council Chambers at the Tow°n Hall, in the Town
of Los Gatos, as the time and puce for the hearing by the Town
Council of all persons interested in, or objecting to, the proposed
vacation; that September 6, 1954, being a legal holiday, and being
a regular meeting of the Town Council, by reason of Government
Code Section 54954 such regular meeting shall be held on September 7,
1954; that notice of said meeting to be held September 7, 1954
was regularly and duly posted at the Town Hall, Town of Los Gatos.
Section 9. That the matter of said proposed vacation
came on regularly for hearing before the Town Council of the Town

of Los Gatos at its regular meeting on the 7th day of September,
1954, and at such hearing the said Town Council heard the evidence
offered by all persons interested in said proposed vacation;
and a full hearing thereon having been ha.d, the matter was
submitted for determination.
Section 10. That the Town Council of the Town of Los
Gatos hereby finds and determines from all.the evidence submitted,
that that portion of WEISER ALLEY described in said Ordinance
No, 364, and hereinabove more particularly described, is unneces-
m " for present or prospective public-street purposes; and said
portion of 'ArEISER ALLEY is hereby ordered vacated.
Section 11. This Ordinance shall be published in the
"Los Gatos Daily Times", a newspaper of general circulation,
published and circulated in the Town of Los Gatos, California.;
and the Town Clerk of the Town of Los Gatos shall cause a certi-
fied copy of this Ordinance, attested by the Town Clerk under
the Seal of the Town of Los Gatos, to be recorded in the Office
of the County Recorder of the County of Santa Clara, within whic h
the Town of Los Gatos is located.
Section 12, Introduced at a regular meeting of the Town
Council of the Town of Los Gatos or, the 7th day of September, 1954.
PASSED AND ADOPTED AS AN ORDINANCE OF THE TOWN OF LOS
GATOS, AT A REGULAR MEETING OF THE T01h7N COUNCIL held on the
