AN ORDINANCE ADOPTING BY REFERENCE AND MODIFYING
THE 1952 EDITION OF THE UNIFORM PLUMBING CODE AND
PROVIDING FOR PENALTIES.
THE TMIN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
Section 1(.a) Rules and Regulations for Protection of the
Public Health and Safety, Requiring a Permit for the Installation
or Alteration of Plumbing and Drainage Systems, Creating an Ad
-mix istrative Officer and Prescribing his Duties, Defining Certain.
Terms, Establishing Minimum Regulations for the Installation,
Alteration or Repair of Plumbing and Drainage Systems, and the
Inspection thereof; Providing for the Issuance of Permits and the
Collection of Fees therefor, having been printed as a code in
book form consisting of one volume, and particularly from the
center of Page 1-A to Page 97, inclusive, being entitled "Uniform
Plumbing Code 1952 Edition" adopted at the Twenty-Second Annual
Conference in October, 1951 by the Western Plumbing Officials
Association, not less than three copies of the Uniform Plumbing
Code 1952 Edition, all certified to be true copies by the Town
Clerk of the Tvwn of Los Gatos, having been for at least 15 days
preceding the Public Hearing on this ordinance, and continuously
since, and are now, and shall be kept on file in the Office of the
Town Clerk of the Town of Los Gatos. for public inspection thereof;
reference being hereby made to said Uniform Plumbing Code 1952
Edition, for all the regulations, provisions, conditions, terms
and requirements therein shown; and said regulations, provisions,
conditions, terms and requirements and said Uniform Plumbing Code
1952 Edition are and each is hereby adopted by reference and made
a part hereof, the same as if fully set forth in this ordinance
and are and each is by such reference adopted as Sections of this
ordinance, being the same numerical Section designations as appear

in said Uniform Plumbing Code 1952 Edition, except as modified in
sub-section (b) hereinafter set forth; and as such, are and each
is adopted as and for the Plumbing Code of the Town of Los Gatos.
(b) (1) That wherever the words "Permit" or "Permits"
appear in said Uniform Plumbing Code there
shall be substituted in lieu thereof, the words
"Written Permit" or "Written Permits", and that
all permits required to be issued by said
Plumbing Code shall be in writing signed by
the.Building Inspector of the Town, or his duly
authorized deputy. Said written permits shall
be issued in triplicate; one to the applicant,
one filed with the Town Clerk, and one shall
remain on file with the Building Inspector.
(2) The following sentence is hereby added to
Section 1.13: "Fees (other than for sewer
connection and inspection) shall not be re-
quired for issuance of permits for buildings
erected or remodeled for and owned by the
United States of America, State of California,
County of Santa Clara., Town of Los Gatos.
Los Gatos Union High School District, Los
Gatos Union Elementary School District, or
any other political subdivision of the State
of California."
(3) The first paragraph of Section 1.8r-Violat-
ions and. Penalties, of the Uniform Plumbing
Code is hereby omitted and deleted therefrom.
(4) Sections 1.2 to 1.4, inclusive, are hereby
omitted and deleted therefrom.
(5) Section 1.11 (a) shall read as follows:
"No permit shall be issued to any person, to
do, or cause to be done any plumbing or
drainage work regulated by this Code except
to a person, holding a valid, unexpired and

unrevoked Plumber's Business License as
required by the Town, except when and as
otherwise hereinafter provided in this
section."
(6) Sections 2.1 to 2.15, inclusive, are hereby
omitted and deleted therefrom.
(7) Sub-section (d) is hereby added to Section
403 : "No house sewer of less than four
inch (40) shall be permitted."
(8) Section 1103--- House Sewer Materials (a),
shall read as follows: "The house sewer
beginning three feet (31) from any building
or structure shall be of cast iron pipe,
vitrified clay pipe or of such other mat er-
ials as may be approved by the administrat-
ive authority. 11
(9) That wherever the words "Administrative
',.,Authority" appear in said Uniform Plumbing
Code there shall be" "substituted in lieu there-
of the words "Building Inspector".
Section 2. Any person, firm or corporation violating any
of the provisions. of said code, as adopted herein, or of the
ordinance, shall be deemed guilty of a misdemeanor and each such
person, firm or corporation shall be guilty of a separate offense
for each and every day, or portion thereof, during which any vio-
lation of any of the said provisions of said code, or of this
ordinance, is committed, continued or permitted, and, upon con-
viction thereof, shall be punished by a fine of not more than
FIVE HUNDRED DOLLARS ($500.00), or by imprisonment in the County
Jail for not more than six (5) months, or by both such fine and
imprisonment."
Section 3. This Ordinance shall not be construed as
imposing upon the Town of Los Gatos any lability or responsibility
for damage resulting from defective buildings; nor shall the Town
of Los. Gatos, or any official or employee thereof, be held as
assuming any such liability or responsibility by reason of the
inspection authorized thereunder.
Section 4. All Ordinances or parts of Ordinances in con-
flict with this Ordinance are hereby repealed.
Section 5.. This Ordinance shall be published once within
fifteen (15) days after its final passage in the OLos Gatos Daily
Times", a newspaper of general circulation, printed and published
in the Town of Los Gatos, California,
Introduced at a regular meeting` of the Town Council of the
Town of Los Gatos after a Public Hearing thereon held in the manner
and after notice given thereof as required by law, this day
of 1954,
