AN ORDINANCE AMENDING ORDINANCE NO. 249 OF THE TOWN
OF LOS GATOS, ENTITLED "AN ORDINANCE ADOPTING A
UNIFORM BUILDING CODE, ESTABLISHING FIRE ZONES AND
PROVIDING FOR PENALTIES", ADOPTING BY REFERENCE AND
MODIFYING THE 1952 EDITION OF THE UNIFORM BUILDING
CODE, VOLUME i, AS COFaECTED, AND VOLUME III, AS
CORRECTED, AND PROVIDING FOR PENALTIES.
THE TOWN COUNCIL OF THE TUdN OF LOS GATOS DOES ORDAIN
AS FOLLOWS:
Section 1. That Sections 1 and 8 of Ordinance No. 249
entitled, "An Ordinance Adopting a Uniform Building Code, Estab-
lishing Fire Zones and Providing for Penalties", passed and
adopted by the Town Council of. the Town of Los Gatos on the
16th day of December, 1940, be, and the same is hereby amended
to read as follows:
"Section 1.
(a) Rules and Regulations for the erection,
construction, enlargement, alteration, repair,
moving, removal, conversion, demolition,
occupancy, equipment, use, height, area, and
maintenance of buildings or structures; pro-
viding minimum standards to safeguard life or.
limb, health, property, and public welfare,
by regulating and controlling the design,
construction, quality of materials, use and
occupancy, location and maintenance of all
buildings and structures and certain equip-
ment within the Town; providing for the is-
suance of permits and collection of fees
therefor, having been printed as a code in
book form, consisting of Volume I (pagds 19
to 308, inclusive), together with printed

corrections and revisions to 1952 Edition
Uniform Building Code, and Volume III, said
Code being entitled as follows: 'Uniform
Building Code 1952 Edition Volume I' and 'Uni-
form Building Code Volume III Uniform Building
Code Standards 1952 Edition', not less than
three copies of Volume I, together with said
printed corrections and revisions, and not less
than three copies of Volume III, all certified
to be true copies by the Town Clerk of the Town
of Los Gatos, having been for at least 15 days
preceding the Public Dearing on this ordinance,
and continuously since, and are now, and
shall be kept on file in the Office of the
Town Clerk of the Town of Los Gatos for pub-
lic inspection thereof; reference being hereby
made to said Volume I. together with said
printed corrections and revisions, and Volume III
of said Uniform Building Code 1952 Edition,
for all the regulations, provisions, conditions,
terms and requirements therein shown, and said
regulations, provisions, conditions, terms and
requirements and said Volume I, together with
said printed corrections and revisions, and
said Volume III of said Uniform Building Code
1952 Edition, are and each is hereby adopted
by reference and made a part hereof, the same
as if fully set forth in this ordinance and
are and each is by such reference adopted as
Sections of this ordinance, bearing the same
numerical Section designations as appear in
said Uniform Building Code with exceptions

as are hereinafter set forth in Sub-section
.1(0)1 , and as such, are and each is adopted
as and for the Building Code of the Town of
Los.Gatos.
"(b) That wherever the words 'Permit' or 'Permits'
appear in said Uniform Building Code there
shall be substituted in lieu thereof, the
words 'Written Permitt or tWrittet Permits',
and that all permits required to be issued by
said Building Code shall be in writing signed
by the Building Official, or his duly authoriz-
ed deputy. Said written permits shall be
issued in triplicate; one to the applicant,
one filed with the Town Clerk, and one shall
remain with the Building Inspector.
"(c) (1) The following sentence is hereby added to
Section 303 (a): 'Fees shall not be requir-
ed for issuance of permits for buildings
erected or remodeled for and owned by the
United States of America, State of Califor-
nia, County of Santa Clara, Town of Los
Gatos, Los Gatos Union High School District,
Los Gatos Union Elementary School District,
or any other political subdivision of the
State of California. 1
(2) Sub-section: 4 is hereby added to Section .
303 (b) under ' EXCEPTIONS: ' 'Buildings
erected or remodeled for the United States
of America, State of California, County of
Santa Clara, Town, of Los Gatos, Los Gatos
Union High School District, Los Gatos

Union Elementary School District, or any
other political subdivision of the State
of California.t
(3) Section 306 (a) shall read as follows:
'Section 306 (a) USE ARID OCCUPANCY.
No new building nor remodeled building,
nor addition to any existing building,
shall be occupied or used for any use
other than that shown on the Building
Permit until a certificate of occupancy
shall have been issued by the wilding
Official.'
(4) Section 2522 (2) shall read as follows:
'Section 2522 (2). In all stud walls and
partitions including furred spaces, so
placed that the maximum dimension of any
concealed space is not over seven.feet (71)-t
(5) The last paragraph of Section 4504 shall
read as follows:
'Clearance above grade over eight feet
(81)--one inch (10) of projection is
permitted for each additional inch of
clearance, provided that no such project-
ion shall exceed a distance of two feet (29.'
(6) Section 205 of Volume I of the Uniform
Building Code is hereby omitted and
deleted therefrom.
48ection 8. Any person, firm or corporation violating
any of the provisions of said code, as adopted
herein, or of this ordinance, shall be deemed
guilty of a misdemeanor and each such person, firm
or corporation shall be guilty of a separate offense
for each and every day, or portion thereof, during
which any violation of any of the said provisions
of said code, or of this ordinance; is committed,
continued or permitted, and, upon conviction
thereof, shall be punished by a fine of not more
than FIVE HUNDRED DOLLARS ($500.00), or by impri-
sonment in the, County Jail for not more than six
(6) months, or by both such fine and imprisonment."
Section 2. This Ordinance shall not be.construed as
imposing upon the Town of Los Gatos any liability or responsibility
for damage resulting from defective buildings; nor shall the Town
of Los Gatos, or any official or employee thereof, be held as
assuming any such liability or responsibility by reason of the
inspection authorized thereunder.
Section 3. All Ordinances or parts of Ordinances in con-
flirt with this Ordinance are hereby repealed.
Section 4. This Ordinance shall be published once within
fifteen (15) days after its final passage in the "Los Gatos Daily
Times", a newspaper of general circulation, printed and published
in the Town of Los Gatos, Calif ornia.
Introduced at a regular meeting of the Town Council of the
Town of Los Gatos after a Public Hearing thereon held in the manner
and after notice given thereof as required by law, this Z day
of , 1954.
