EAW: S KIj: S 2/25/5 G/Bc 3t ! .;,6 f { ORDINANCE NO. 343 CALLING A SPECIAL ELECTION IN THE TOWN OF LOS GATOS y FOR THE PURPOSE OF.SUBMITTTNG TO THE ELECTORS OF 9 SAID TOWN TWO PROPOSITIONS OF INCURRING BONDED INDEBTEDNESSES OF SAID TOWN FOR THE ACQUISITION, a CONSTRUCTION AKD'COMPLETION OF CERTAIN MUNICIPAL j +_MPROVEMENTS; DECLARING THE ESTIMATED COSTS OF SAID 'i MUNICIPAL IMPROVEMENTS, THE AMOUNT OF THE PRINCIPAL OF SAID IYDEBTEDNESSES TO BE INCURRED THEREFOR, AND THE MAXIMUM RATE OF INTEREST TO BE PAID THEREON, PROVIDING FOR THE CONSOLIDATION OF SAID ELECTION r WITH THE GENERAL MUNICIPAL ELECTION, AND PROVIDING i FOR NOTICE THEREOF STORM DRAINAGE PROJECT M`UNIC IPAL BUILDINGS The Council of the Town of Las Gatos does ordain as fo11ows WHEREAS, the CoUncl of the Town of Los Gatos, by two resolutions passed and adopter: at a regular rueeting thereof on 'i the 38th day of February, 1952, by a two-thirds vote of all its members, did determine that the public interest and necessity de- mand the acquisition and construction and completion of the r ±i municipal improvements hereinafter mentioned, that the said muni- cipal improvements are necessary and convenient to carry out the ; objects, purposes and powers of the Town, that the cost of the proposed municipal improvements will be too great to be paid out of the ordinary annual income and revenue of the Town, and that the indebtednesses proposed to be incurred =gill require an ex- penditure greater than the amount allowTed for it by the anneal tax levy of the Town, which resolutions were duly entered in the minutes of the said, meeting and are now on file and of record in the office of the Town Clerk.. NOW, THER~~'0_'RE IT IS ORDERED., . as follows: 11. A special municipal election is hereby called and ordered and will be held in the Town of Los Gatos on Tuesday, the 8th day of April, 1952, at which election shall be submitted to the qualified voters of the Town the question of incurring two bonded indebtedr_esses by the Town for the objects and purposes set forth in the following propositions, to-wit. 5 S i r, 11PROPOSITION NO.: 1: Shall the Town of Los Gatos incur a bonded j (MUNICIPAL BUILDINGS) indebtedness in the principal amount of i $60.,000 in accordance with the provisions of the Ordinance Calling the Election at which this proposition is submitted, for the objects and purposes of acquiring and con- strutting or completing the following municipal improvements, to-wit: a building='or,,buildings for municipal purposes and uses, and the acquisition of lands and easements therefor, and by doing :;such incidental work as may be necessary to complete the same? ,;PROPOSITION NO. 2s Shall the Town of Los Gatos incur a bonded !{(STORM DRAINAGE) indebtedness' in the principal amount of $150,000 in accordance with the provisions ii of the Ordinance Calling-the Election at which this proposition ifis submitted, for the objects and purposes of acquiring and con ' a1 strutting or completing the following municipal improvements, ~!to-Wit.: storm water drainage collection and disposal facilities ;and the acquisition of lands and easements therefor and by doing :!such incidental work as maybe 'necessary to complete the same? 2. The estimated cost of the municipal improvements as set forth in Proposition No. 1 is the sum of $60,000 and as set +forth in Proposition No, 2 is the sum of $150,000, and the amount of the principal of the indebtedness proposed to be incurred for the municipal improvements described in Proposition No. 1 is the s24 of $60,00.0, and for the municipal improvements described in Prop- ' I; osition No 2 is the sum of 1$150,,000. j 3. The Council does hereby submit to the qualified voters at the said sp.ecial'municipal election this ordinance and the propositions set forth in Section 1 hereof. The Council proposes ~toissue and sell bondsof the Town in the amount andforetheob- jects and purposes specified in the propositions if two-thirds of the qualified electors voting on such propositions vote for them.. 4. If two-thirds of the qualified electors voting on either of the propositions vote in favor thereof, the proposition shall be deemed adopted The bonds shall be negotiable in form rand of the character known as.serial, and shall bear interest at a rave not exceeding five per cent (5f) per annum, payable semi- annually. 5. The said special municipal election shall be held and ;conducted and the votes thereof canvassed, and the returns thereof lmade, and the result thereof ascertained and determined as herein 2 t provided; and in'all particulars not prescribed by this ordinance the election shall be conducted as other municipal elections. 6. The said special municipal election is. hereby consol- idated with the general municipal election which will be held within the Town of Los Gatos, on Tuesdays the 8th day of April, 1952. The special municipal election shall be held in the manner Ii e, provided for.the I general :municipal election; and the precincts, ~ polling places., and officers of election shall be the same as those set forth in'Resolution Designating and'`Providing for the Consolidation of Precincts, Listing Polling Places and Election Officers and Providing for the Giving of.: Notice, adopted by the Council on Mar eh 3 1952. 7. The elections hereby consolidated shall be held in, all respects as if there were only one election.and only one f or ra of ballot shall be used m t 8. All persons,qualified to vote at the general municipal' t election shall be'qualifed to vote on the propositions submitted I at the special municipal election. g: Ballots for the election shall be provided of the form and to the number' provided by law. On the ballots, in addition to' any other printed matter which may be required by law, two voting squares shall be set off to the right of each of the propositions submitted at the election, in the manner provided by law, one ';having the word ''YES" printed before it and the other having the word "NO" printed before it. fj 10. Each.voter may. vote on either one or both of the prop ,iositions hereby submitted. Each voter to vote for either proposi lion and for incurring the bonded indebtedness shall stamp 4ross '(x) in the blank.space opposite the word "YES" on the ballot to the right of the proposition, and to, vote against either proposi- tion and against` incurring the indebtedness shall stamp a cross IF' (x) in the blank space opposite the word "NO" on the ballot to the right of the proposition. x 3 a E ll. The polls shall be opened at 7:00 o;clock A. M. of isthe day of the election and shall be kept open until 7:00 o'clock .~P, M. of the same day when the polls shall be closed, except as ,to voters in line as provided in Section 5734 of the Elections Code. This Section is subject to the provisions of law governing ` E the general municipal election which will be observed.' 12.
