Ord 0342-NO PERSON SHALL BLOCK OR OBSTRUCT ANY PUBLIC STREET, SIDEWALK OR PLACE OR ANY ENTRANCE, EXIT OR APPROACH TO ANY PLACE OF BUSINESS IN OR UPON ANY PUBLIC STREET, SIDEWALKORDINANCE NO. FOLLOWS: Section 1. No person individually or in concert with another person or persons within the Town of Los Gatos shall block or obstruct any public street, sidewalk or place or any entrance, exit or approach to any place of business in or upon any public street, sidewalk or place in a manner calculated or with the intent to prevent the free passage therealong or therethrough of any other person who is entering, occupying or leaving any place.of business, or who is performing any services or labor, or who is seeking or obtaining employment, or who is purchasing, selling, using, deliver- ing, transporting or receiving any goods, wares, 'merchandise, services, entertainment, accommodations or articles, or who is attempting or seeking to do any of the foregoing, or to prevent the free passage therealong or therethrough of any vehicle or conveyance operated by or in the custody of any such other person or in which any such. other person is riding or attempting to ride. Section 2. It is unlawful within the Town of Los Gatos for any person or persons to beset or picket the premises of another, or any approach thereto, where any person is employed or seeks employment, or any place or approach thereto where such employee -1- THE TOWN COUNCIL OF THE TOWN OF LOS G.ATOS DOES ORDAIN AS i or person seeking employment lodges or resides, for the purpose of j' inducing such employee or person seeking employment, by means of is threats of violence or acts of violence to quit his or her employ- ment or to refrain from seeking or freely entering into employment. Section 3. Peaceful picketing is hereby declared lawful. Peaceful picketing is hereby defined to constitute the lawful dis- semination of information concerning the facts of a dispute by a person or persons in the vicinity of the place of business of , an establishment where an alleged dispute exists. A picket is defined as a person engaged in picketing. Section 4. It shall be unlawful for any picket to sit, i-Eand, march to and fro before any place of business involved in a. dispute other than upon the outer one-third of the sidewalk in front of said place of business, said outer one-third being defined as that one-third portion of the sidewalk next to the curb; PROVIDED, HOWEVER, that in areas within the gown of Los Gatos where no curb exists it shall be unlawful for any picket to sit, stand, march to and fro before any place of business involved in a dispute within an area of five (5) feet of the entrance of the building in which said business is located. Section 5. Wherever the free passage of any street or sidewalk in the Town of Los Gatos shall be'obstructed by a crowd, the persons composing such crowd shall disperse or move on when directed to do so by a police officer. It shall be unlawful for any person to refuse to so disperse or move on when so directed to do so by a police officer as herein provided. Section 6. SEVERABILITY If any section, sub-section, sentence, clause or phrase of this Ordinance is for any reason held by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Town Council hereby declares that it would have passed this Ordinance and each section, sub-section, sentence, clause and phrase hereof, irrespective of the fact that any one or more sections, sub-sections, - 2- S sentences, clauses, or phrases be declared invalid. If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the Ordinance which can be given effect without the invalid pro- vision or application, and to this end the provisions of this Ordinance are declared to be severable. Section 7. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and on conviction thereof, shall be fined the sum not to exceed Five Hui dred. and no/100 ($500.00) Dollars or imprisonment in the County Jail not to exceed six (S) months or by both such fine and imprison- meat. Section S. This Ordinance shall be published once in the LOS GATOS DAILY TIMES, a newspaper published in the Town of Los Gatos.
