Ord 0316-AMENDING ORDINANCE NO. 276 OF THE TOWNF y ORDINANCE NO. 3 f 4~ AN ORDINANCE MENDING ORDINANCE NO. 276 OF THE TOWN OF LOS GATOS RELATING TO ZONING. WHEREAS, the Town Council of the Town of Los Gatos finds and deems it necessary for the public interest, health, comfort, convenience, safety and general welfare to amend the Town Ordin- ance No. 276 by changing the first hereinafter described property hereinafter set forth in Section 1 hereof from an "R-2" district to a "C" district, and by changing the second hereinafter described property hereinafter set forth in Section 2 hereof, from an 11R-211 district to a. "C" district, and by changing the third hereinafter described property hereinafter set forth in Section 3 hereof, from an "R-11i district to a ,all district, and by changing the fourth hereinafter described property hereinafter set forth in Section 4 hereof, from an IIR-1" district to a 11011 district; and WHEREAS, the Town Council further finds and deems it necessary for the public interest, health, comfort, convenience, safety and general welfare to amend Section 8.1 (c) 2 of said Ordinance to provide for a rear yard of not less than ten (101) feet on the rear of any lot in a f1v district; and to amend Section 8.1 (c) 3 to provide a front yard of not less than ten (101) feet in depth in a 'IC" district; and. to amend Section 8.1 (e) to provide for adeoyuate automobile parking space; and WHEREAS3 it appears that all of the procedural require- ments of Section 15 of said Zoning Ordinance No. 276 have been fully complied with. THE TO14N COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: Section 1. What Section 4.0 of Ordinance No. 276 of the Town of Los Gatos, a sectional district map, is hereby amended in -1- . 0 part so that the district and boundaries shown thereon., and particularly the portion lying and being on the easterly side of North Santa Cruz Avenue between Saratoga Avenue and Cypress Avenue and North Santa Cruz Avenue and the Southern. Pacific Railroad right- of-way, and shown as a "R-2" district, is and will be a "oil district instead of an "R-2" as now shown on said sectional district map being Section 4.0 of said Ordinance No. 276 of the Town of Los Gatos. Section 2. That Section 4.0 of Ordinance No. 276 of the Town of Los Gatos, a sectional district map, is hereby amended in Dart so that the district and boundaries shown thereon, and particularly the portion lying and being on the westerly side of North Santa Cruz Avenue between Saratoga Avenue and Olive Avenue and shown as "R-2" district, is and will be a "C" district instead of a "R-2" as now shown on said section district map being Section 4.0 of said Ordinance No. 2'76 of the Town of Los Gatos. Section 3. That Section 4.0 of Ordinance No. 2'76 of the Town of Los Gatos, a sectional district map, is hereby amended in part so that the district and boundaries shown thereon, and parti- cularly the portion lying and being on the easterly side of North Santa Cruz Avenue between Cypress Avenue and Williams Street and North Santa Cruz Avenue and the Southern Pacific Railroad right- of-way, and shown as an ".REi l" district, is and will be a "C" district instead of a "R-1" as now shown on said sectional dis- trict map being Section 4.0 of said Ordinance No. 276 of the Town of Los Gatos. Section-4. That Section 4.0 of Ordinance No. 276 of the Town of Los Gatos, a sectional district map, is hereby amended in part so that the district and boundaries shown thereon, and particularly the portion lying and being on the westerly side of -2- r North Santa Cruz Avenue between Olive Avenue and Mariposa Avenue and now being a "R-191 district, is and will be a '1011 district to a depth of the present lots facing North Santa Cruz Avenue, not'., however, exceeding 150 feet in depth, instead of "R-l"district as now shown on said sectional district map being Section 4.0 of said Ordinance No. 276 of the Town of Los Gatos. Section 5. That Section 8.1 (c) 2 of Ordinance No. 276 of the Town of Los Gatos is hereby amended to read as follows: Section 8.1 (c) 2: In case of a C district bordering on property in any R or A districts the front yard or side yard required shall be the same as required for the adjacent R or A districts; except that on a corner lot adjacent to a key lot the side yard adjacent to the street shall be not less than a of the front year required for the key lot. There shall be a rear yard of not less than 10 feet on the rear of any lot in a "C" district. Section 6. That Section 8.1 (c) 3 of Ordinance No. 276 of the Town of Los Gatos is hereby amended to read as follows: Section 8.1 (c) 3: Front Yard Required: Each lot shall have a front yard of not less then 10 feet in depth; providing that in case a building line for the street upon which the lot faces is established by the Street and Highway Plan of the ?Master Plan of the Town, then the front yard shall have a depth then not less than that specified thereby. Section That Section 8.1 (e) of Ordinance 276 of the Town of Los Gatos is hereby amended to read as follows: -3- n • a s uY Section 8.1 (e) Automobile Parking Space: There shall be provided at the time of the erection of any main building or accessory building or structure, or at the time any main building, or accessory building, or structure is enlarged or increased in capacity, mini- mum off-street parking accommodations with adequate pro- vision for ingress and egress by standard size automobiles and motor vehicles as follows: 1. Private garages for dwellings: There shall be at least one (1) permanently maintained parking space in a private garage on the same lot with the main building or enlargement of a main building, for each dwelling unit in the case of a new building, or for each dwelling unit added to an existing-building. Such parking space shall not be less than eight (81) feet wide by twenty (201) feet long and seven . (7' ) feet high. 2. Parking space for dwellings: There shall be at least one (1) permanently maintained parking space of Two Hundred Fifty (250) square feet on. the same lot with the main building or enlargement of the main building, for each dwelling unit in the case of a new building or for each dwelling unit added to an exist- ing building, or in lieu thereof such parking spaces shall be provided in a building as required in sub- paragraph (1) of this section. 3. For buildings other than dwellings: For a new main building or new accessory building or structure or for the enlargement or increase of any existing main building or accessory building or -4- • y structure, there shall be at least a parking space of an area equal to one-half of the total lot area unless modified as hereinafter -orovided, and provision shall be made for adequate ingress and egress to said parking space. Parking space as required above shall be on the sane lot with the main buildings or structures. 4. Every parcel of land hereafter used as a public park- ing area shall be developed as follows, subject to the approval of the plot plans thereof by the Planning Com- mission of the Town of Los Gatos: a. Such area shall be paved with an asphaltic or concrete surfacing; shall have appropriate bumper guards where needed; b. That before any building permit shall be issued by the Building Inspector of the Town of Los Gatos for any new building or structure, the plans of the building or structure proposed to be erected in any "C." district and a plot plan of the lot shall be submitted to the Planning Commission for review and to determine compliance with this section, and a duplicate copy of said plot 'clan shall be filed with the Planning Commission. The Planning Commission shall have the mower to recommend variances in the applications of any of the provisions of this section to vary or modify the strict application thereof in cases in which there are practical difficulties or unnecessary hardships in the Tray of such strict application. Appeal from any decision of the Plan- ning Commission may be made to the Town Council in written form stating reasons for such appeal, -5- 'Section 8. This Ordinance shall be published once in LOS GATOS DAILY TIMES, a newspaper of general circulation, printed and published it the Town of Los Gatos. Section 9. If any section, sub-section, sentence, clause or phrase of.this ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The Town Council hereby declares that it would have passed this ordinance and each section, sub-section, sentence, clause and phrase hereof, irrespective of the fact that any one or more sec- tions.. sub-sections, sentences, clauses, or phrases be declared invalid. The above and foregoing Ordinance was duly and regularly introduced at an adjourned regular meeting of the Town Council of the Town of Los Gatos held on the 12th day of April, 1950, and was thereafter on the 18th day of April, 1950, duly and regularly adopted at an adjourned regular meeting of the Town Council of the Town of Los Gatos by the following vote: AYES : COUNC IL11EN 61 NOES: COUNCILMEN -6- ABSEN`T' : COUNCILMEN
