Ord 0268-LICENSING DOGS AND PROHIBITING THEIR RUNNING AT LARGEORDI?:MgCE NO. 268 A ORDINvAI CE LICEI SING DO S JUID PROHIBITING THEIR RUiT ING AT Lf~R?GE. - The Town Council of the Town of Los Gatos does ordain as fol!ohs Section 1. It shall be un rful for any person to have, maintain or harbor within the Town. of Los Gatos, a dog or dogs without first obtaining from the Town License Collector of said town an annual license so to do, upon the payment of the fee hereinafter provided. Section 2. The word "dog" as used in this ordinance shall include male and female. Any female dog Vrich after an operation by a veterinarian licensed by the State of California to practice veterinary medicine and surgery, the certificate of whom, stating the fact that such female dog has been rendered neuter, is presented to the Town License Collector, it shall be considered for the pu?rposes of this ordinance, a male dog. Section 3. The license fee for keeping and maintaining a dog or dogs within the Town of Los Gatos is hereby fixed as fol- lows: For every male dog or female neuter dog, the sum of $2.00 per year? and for every female dog, the sum of $3.00 per year, excepting puppies under six months of age, for which no license shall be required, provided. that such puppies shall not be allowed to run at larg e, provided further, that any puppy allowed to run at large, shall be subject to all the regulations herein set forth for adult dogs. Each such license fee shall be payable an- nually armed in advance on or before the first day of Janu- ary and shall be good only for the current year in which issued. if there shall be a delay of more tI= thirty days in procuring such license, the fee shall be doubled. Section 4. The 'own License Collector shah each year, at the expense of the Toxin, provide a sufficient number of metal- lic or other suitable tags to meet the requirements of the Town, numbered from one (l) upward consecutively, on which tags shah be stamped the year of issue, the sex of the dog (male or female) and the legend "Town of Loos Gatos Dog License; Er and he shall is- sue the same in consecutive order, as may be required, keeping an account thereof. When any tag shall have been lost, a new tag will be is- sued in lieu thereof upon payment of twenty-five (25) cents to the Town License Collector, provided that the annual license fee, provided in Section 3 of this Ordinance shall have been paid. Section _5. The Torn License Collector shall also cause to be -orinted a sufficient number of receipt blanks to meet the Town°s requirements which shall provide for a description of the dog for which the license is paid, the n:aamber for which said tag has been issued, and the nave and address of the owner of the dog for which said tag is issued. Section 5. The Town License Collector shall keep a reg- ister wherein shall be kept the name of the owner to whom the tag was issued, a description of the dog, the number of the tag given, and the date thereof. Section 7. The Town License Collector is hereby declared to be the Town Dog License Collector, and said license collector shall upon payment of such license tax by any owner, caretaker, or custodian of any dog within the Town of Los Gatos, deliver to -2- such person an appropriate tag to indicate that such license has been paid together with a receipt signed by himself for such sure of money as shall have been paid as a license tax, the namber of which shall correspond accurately wits. the tag, and make a record on a retained copy thereof which will remain as a permanent record in the office of the above mentioned Town License's Collector. Section 8. The owner, caretaker, or custodian of any dog described in the Ordinance on which the license tax has been paid and a numbered license tag issued, shall securely fasten such tag to a substantial collar, or body harness, which the dog shall gear at all times when not in the house or building of the caretaker, ov,Tner, or custodian. Section 9. Whenever any person or persons owning, having, or having the care or charge, custody or possession of any dog or i dogs within the town limits of the Town of Los Gatos, and who, after thirty (30) days following the due date shall rail to pay the license fee provided and specified in this ordinance, such person i or persons shall be deemed to have committed a misdemeanor and I the Poundmaster, Deputy Poundmaster, Chief of Police, or policeman I after due notice and legal process of law shall have authority to enter updn the premises of such owner, caretaker, keeper, or cus- todian and remove such dog or dogs, over six months of age, as I are unlicensed, and confine either of then in the Town Pound where I it or they shall be held for a period of three (3) days, unless i sooner redeemed, as hereinafter provided by this ordinance. Section 10. The Poundmaster shall upon taking up and ia- pounding any dog or do gs, withir, twenty-four (24) hours, post in a conspicuous place at the Town Hall and in two other publ--c places within the 'down, a description of the dog or dogs with a -3- notice that the dog or dogs may be redeemed within three {3} days of the posting of said notices by the payment by the owner, care° taker, or custodian of such dog or dogs to the Poundmaster the sup of One ($1.00) dollar for each dog impounded as an impoundi_ng f eej and fifty (50) cents per day for the impounding thereof from the date of such impoundment, plus the Town dog license fee as provided in Section 3 of this ordinance. If such dog is not, or dogs are not, redeemed by the owner after notice, said dog or dogs may be sold for the impounding fees accruing thereon. Any dog or dogs not redeemed, or sold, as above provided, shall be humanely destroyed and be disposed of by cremation or by burial as may be hereafter provided by contract or otherwise. Section 11. It sham be unlawful for any person not the owner thereof and without the consent of the owner thereof, to hold or retain possession of any dog for a longer period than twenty-lour (24) hours, unless such person shall report the same with a true description thereof to the person in charge of the gown Pound. Section 12. it shall be unlawful for any person owni ngy having an interest in, harboring, or having charge, care, control,, custody, or possession of any dog to cause or permit such dog to be in or upon any public street, alley, or other public place, or in or upon any unenclosed lot or premises, unless such dog be se- I' curely confined by a strong leash, securely and continuously held by the person owning, having an interest in, harboring, or having i charge, care, control, custody, or possession of such dog, or unless such dog be confined within an automobile. Section 13. No person owning or having care, charge, custody, or control of any dog shall cause, permit or allow the same to go to, nor shall it be taken to, or into a place where food is handled, prepared, served, or sold, nor in any public or private school building or school ground in the incorporated area of the Town of Los Gatos. Section 14. Any dog found running at large, contrary to the provisions of this article shall be impounded and disposed of in the manner prescribed in this ordinance, except that the owner of any licensed or unlicensed dog which shall be redeemed under the provisions of this ordinance shah pay to the Poundmaster the penp,aty of Two and 501340 Dollars ($2.50) at the time of the re- dembtion of the animal on the first violation; Five and no/144 Dollars ($5.04) for the second violation; Ten and no/144 ($10.00) Dollars for each successive violation thereafter. These penalties shall be in addition to any fees or penalties prescribed in this ordinance. Section. 15. It shall be unlawful for any person- to have, maintain or harbor within the Torn of Los Gatos more than two do If both of said dogs be females, then one of said dogs shall be rendered neuter as provided by section 2 of this ordinance. Section 16. Ordinance No. 79 of the Torn of Los Gatos, entitled, "An ordinance to amend an ordinance entitled,VAn ordin- ance creating a public pound, and providing for the burial _ of dead animals t". passed and adopted by the board of trustees of the Toes of Los Gatos on the twentieth day of January, 1896; and ordinance No. 162 of the Town of Los Gatos, entitled, "An ordinance requir- ing the muzzling of dogs unless they are kept within a sufficient enclosure, or led or controlled by a line, rope, or chain," passed and adopted by the board of trustees of the Town of Los Gatos on the twenty-second day of December, 1913, are hereby repealed. -5- Section 17. Any person violating any of the provisions of this ordinance shah be deemed guilty of a misdeamor and upon conviction thereof shall be. punished by a fine of not more than Three Mandrecl Dollars ($300,00) or by imprisonment in the County Jail of Santa Mara County for not to:exceed three (3) months, or lby both such fine and imprisonment. All ordinances or Darts of ordinances that conflict here- with are hereby repealed. Section 18, This ordinance shall be published once in ~D the a newspaper of general circulation, printed and published in the Town of Los Gatos. Passed and adopted at a regular meeting of the Town.
