THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DO ORDAIN AS FOLLOWS:
Sec. 1: The Town Council of the Town of Los Gatos hereby
declares it to be its intention to instruct the City Planning
Commission to proceed to prepare zoning studies to rezone the Town
of Los Gatos, and to rezone the said Town. The Town Council also
declares that it is its intention to make studies for the purpose
of dividing the Town into Fire Zones or Districts and adopt a
Uniform Building Code. Each of these proposed matters is inter-
related and interdependent and will take considerable time. The
Town Council declares that the following regulations regulating
building and construction in the present Business District of said
Town, lying outside the present Fire Limits, are of an interim or
emergency nature and are necessary to be adopted at this time to
protect the public interest, welfare, and safety.
Sec. So. No frame or wooden structure shall hereafter be
erected.' enlarged; or altered within, or moved into, that portion of
the Business District of the Town of Los Gatos as described in
Ordinance No. 220 of said Town entitled, An Ordinance Creating a
Comprehensive Zoning Plan for the Town of Los Gatos and Establishing
Three Districts Therein," passed and adopted by the Town Council of
said Town on the 20th day of February, 1928; lying outside the Fire
Limits of said Town; as described in Ordinance No. 203 of said Town
entitled, '"An Ordinance Amending Ordinance No. 199 entitled, 'A
Ordinance Providing for Fire Limits and the Construction and ,uipment
of Buildings in the Town of Los Gatos,'' passed and adopted by the
Town Council of said Town on the 21st day of January, 1924, without
first
having
applied
for and obtained a permit therefor from the
Town
Council
of said
Town. The Building Inspector of said Town shall
not issue any permit therefor until the Town Council has granted its
permit. The requirements of said Ordinance No. 199 of said !own
entitled, An Ordinance Providing for Fire Limits and the Construction
and Equipment of Buildings in the Town.of Los Gatos, passed and
adopted by the Town. Council of said Town-on the 17th day of September,
1923, shall be the minimum requirements for any such frame or wooden
structures erected, enlarged, or altered within., or moved into, said
portion of said Business District. No permit for the erection,
enlargement, or alteration of any building in said portion of said
Business District need be obtained from the Town C.Gu.ncil where said
erection, enlargement., or alteration conforms in all particulars
with the requirements of said Ordinance No. 199 for the erection:,
enlargment, or alteration of buildings within Asa-id. Fire Limits.
Sec. 3a. Any person, firm, or corporation violating any of the
provisions of this ordinance shall be guilty of a misdemeanor and,
upon conviction thereof, shall be punishable by a fine of not more
than ONE HUNDRED DOLLARS ($100.00), or by imprisonment. In the County
jail for not more than thirty (30) days, or by both such fine and
imprisonment.
Sec. 4: This ordinance is hereby declared to be an urgency
ordinance for the immediate preservation of the public peace and
safety and shall be in full effect from and after the date of its
passage. The facts constituting its urgency are as follows:
The unrestricted erection of frame or wooden structures
in the present Business District of the Town, lying outside the
present `ire Limits, is increasing the fire hazards in said district
and is injurious to the public peace and safety. The :own Council
believes that various persons intend to erect frame and wood
buildings and it is necessary in order-to carry out the intentions of
the Town Council, and for the safety and welfare of the public,
that the Town Council have power to prevent the erection, enlarge-
ment, or alteration of any such structures where the same would
endanger the public safety or welfarea
