Ord 0247-REGULATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITHORDINANCE NO. - 9z1 7 AN ORDINANCE OF THE TOWN OF LOS GATOS REGLILATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS ARTICLE I. DEFINITIONS Sec. 1. Whenever any words or phrases used herein are not defined herein but are now defined in the Vehicle Code of this state, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein. See. 2. Whenever in this ordinance the following words and phrases set forth in this Article are used, they shall for the pur- pose of this ordinance have the meanings respectively ascribed to them in this Article. Sec. S. ALLEY. Any street less than twenty-five (25). feet in width between property lines. Sec. 4. CENTRAL TRAFFIC DISTRICT. The following streets and portions thereof: East Main Street from .11 Street to West Main Street.; West Main S-Creet From East Fain Street to' Santa Cruz Avenue; South Santa Cruz Avenue from'North Santa Cruz Avenue . to the southerly property line of Broadway Street; North Santa Cruz Avenue from South Santa Cruz Avenue to the northerly property line of Gray"s Lane-r..` Dean Avenue from North Santa Cruz Avenue to Wilder Avenue s Elm Street Sec. 5. LOADING ZONE. That space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. Sec. 6. OFFICIAL TRAFFIC CONTROL DEVICES. All signs, signals, mark- ings, and devices not inconsistent with this ordinance placed or erected by authority of a public body or official having jurisdibtion, for the purpose of regulating, warning, or guiding -traffic Sec. 7. OFFICIAL TRAFFIC SIGNALS. Any device, whether manually' electrically, or mechanically operated2 by which traffic is alternately directed to stop and to proceed9 and which is erected by authority of a public body or official having jurisdiction... Sec. 8. PARKWAY. That portion of a street other than a roadway or a sidewalk. Sec. 9. PASSENGER LOADING ZONE. That space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers. Sec. 10. PEDESTRIAN. Any person afoot. Sec. 11. PERSON. Every natural'person, firm, co-partnership, associa- tion or corporation. Sec. 12. POLICE OFFICER. Every officer of the police department of thi s town. Sec. 13. 0-SHALL" and "MAY". nShall" is mandatory and u may" is permissive. Sec. 14. (a) STOP when required means complete cessation of movement. (b) STOP OR STAND when prohibited means any stopping of a vehicle except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or official traffic control device. (c) PARK. The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while. actually engaged in loading or unloading passengers or materials. Sec. 15. TRAFFIC.. Pedestrians and vehiclesa either singly or to- gethera'while using any street for the purpose of travel. Sec. 16. TRAFFIC AUTHORITY. The Chief of Police of the Town of Los Gatos. ARTICLE II. OBEDIENCE TO TRAFFIC REGULATIONS. Sec. 17. DUTIES OF POLICE. (a) It shall be the duty of the officers - 2 - of the Police ,Department, to enforce the provisions of this ordinance. (b) Officers of the Police Department are hereby authorized to direct all traffic by voice, hand or signal in conformity with traffic= laws, provided that, in the event of fire or other emergency, police officers may direct traffic as conditions may require notwithstanding the provisions of the traffic laws.. Sec. 18. OBEDIENCE TO POLICE: No person shall wilfully fail or refuse to comply with any lawful order, direction or signal of a police officer~... Stec. 19. DIRECTION OF TRAFFIC. No person ether than an officer of the Police Department or a person deputized by the Chief of Police shall direct or attempt to direct traffic by voice, hand or other signal, except that persons may operate, when and as herein provided, any mechanical push button :signal erected by order of the legislative boy,: of this Town.. Sec. 20. PUBLIC EMPLOYEES TO OBEY TRAFFIC-. REGULATIONS. The provisions of this ordinance shall apply to the driver of any vehicle, owned by or used in the service of the United States Government this State, or any county, city and county or municipal corpora- tion, or other public agency, and it shall be unlawful for any said driver to violate any of the provisions of this ordinance, except as otherwise permitted- in this ordinance. Sec. 21. EXEMPTIONS TO CERTAIN VEBI-CLES. The provisions of this ordinance regulating the operation, parking and standing of vehicles. shall not apply to any vehicle of the police or fire department., any public ambulance, or any public utility vehicle, or any private ambulance, which public utility vehicle or private ambulance has qualified as an authorized emergency vehicle when any vehicle mentioned in this section is operated in the manner specified in the Vehicle Code in response to an emergency call. (b). The foregoing exemptions shall not., however, protect the driver of any such vehicle from the consequences of his - 3 - AND LANES FOR. TRAFFIC. The Traffic Authority is hereby authorized; 1. To install and maintain official traffic signals at such intersections and other places as it may deem necessary for the regulation of traffic; 2._ To establish safety zones at such places as it may deem necessary for the protection of pedestrians; 3. To mark lanes for traffic on street pavements at such places as it may deem advisable, consistent with the Vehicle Code and traffic ordinances of this Town. Sec. 25.' OBEDIENCE TO TRAFFIC CONTROL DEVICES. (a) The driver of any vehicle, and the person in charge of any animal, shall obey the instructions of any official traffic control device applicable thereto placed in accordance with this ordinance unless otherwise directed by a police officer, subject to the exemptions granted by Section 21 of this ordinance. (b) The driver of any vehicle and the person in charge of any animal shall obey the instructions of any barrier or sign erected by any of the public departments of this Town, or public utilities in this Town, or by any other person, pursuant to law. Sec. 26. SIGNS REQUIRED. No provision of this ordinance for which signs or markings are required shah.. be enforced against an alleged violator if, at the time and place of the alleged violation, an official sign or marking is not in glace and sufficiently legible. and visible to be seen by an ordinarily observant person. Sec. 27. OFFICIAL TRAFFIC SIGNALS. Whenever traffic is controlled by traffic control signals exhibiting the words, 'GO", "CAUTION"2 or "STOP", or exhibiting different colored lights successively, one at a tune, the following colors only shall be used, and said terms and lights shall indicate as follows: (a) Green alone or. "GO"* 1. Vehicular traffic facing the signal shall proceed either straight through or tarn right or left unless a sign at such place prohibits either such turn, except that.;, 2. Vehicular traffic shall yield the right-of-way to other - 5 - ,iejaicles and to, pedestrians lawfully within the intersection or adjacent crosswalks at the time such signal is exhibited. 3. Pedestrians facing the signal may proceed across the roadway within any marked or unma.rked,crosswalk® (b) Yellow alone: or with green2 or ICAUTICNu when shown following the green or signal. 1. Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at the intersection butt if such strop cannot be made in safety, a vehicle may be driven cautiously through the intersection. 2. No pedestrian facing such signal shall. enter the roadway until the green or KGOO is. shown alone:. (c) Red alone or "ST01111® 1. Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at an intersection or at such other point as may be indicated by a clearly visible line9 and shall remain standing until the green or '-GO' is shown alone2 except as provided in the next succeeding paragraph. 2. At any intersection not within the Central Traffic }district the driver of a vehicle which is stopped as close: as praeticablre to the right hand curb and at the entrance to the nearest crosswalk may make a right turn but shall yield the- right-of-way to pedestrians and other traffic proceeding as directed by the signal at said intersection. 3. No pedestrian facing such signal shall enter the roadway until the green or "GO" is shown alone. (d) e ringing of a bell in connection with any official traffic signal shall indicate that a change- is taking place o. is to take place in said traffic signal. However; all traffic shall be required to obey the direction of the signal itself; the ringing of a bell is to be construed merely as a warning to traffic of a change in signal. (e) xo person shall disobey the directions of this section except when it is necessary to atop for the purpose of avoiding - 6 - See. 28. Sec. 29. an accidentq or in case of other emergency) or when otherwise directed by a police official. 'LAS ING SIGNALS. When a yellow. lens is illuminated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with added caution. PUSH BUTTON SIGNALS. No person shall operate a pedestrian push button signal other than a pedestrian for the purpose of immediately crossing the roadway. ARTICLE IV. TURNING MO-VEMUS Sec. 30. sec. 31. Sec. 32. SIGNS PROIUBITINC LEFT TURNS. The Traffic Authority may erect and maintain signs at any intersection Prohibiting the making of lefv turns by drivers of vehicles wherever said Traffic Authority determines that such left.turns would cause traffic congestion, or traffic hazard. The making of such left turns may be prohibited between certain hours of any day and permitted at other hours in which event.the same shall be plainly indicated on the signs erected by said Traffic Authority. `~"dll~T LEFT TURNS FRa~BITM. When authorized signs are erected giving notice thereof9 no vehicle shall be turned to the left in violation of the directions contained on said signs. TLMNING MALLS. (a) The Traffic Authority may place markers, buttons or signs within or adjacent to intersections' indicating the course to be traveled by vehicles turning at such intersections. (b) When authorized markers; buttons or other indications Sec. 33. are placed within an intersection indicating a course to be traveled by vehicles turning thereat., no driver of a vehicle shall disobey the directions of.such indications. U-TUERNS IN CERTAIN DISTRICTS. No vehicle shall be turned: at any time at any of the following intersections. in a complete circle or in such manner as to proceed in the opposite direction upon the street upon which said vehicle is travelling at the time of entering said intersection-. ® 7 North and South. ONE ,'IAY STREETS A! ALL fS Sec. 34. THE TRAFFIC AUTHORITY TO SIGN ONE `ivAY STREETS A--ND AI.J.Z-fS. Whenever any ordinance of this city designates any one way street or alley, the Traffic L.-uthority shall place and main- tain signs giving notice thereof, and no such regulations shall be effective unless such signs are in place Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traf'f'ic in the opposite direction is prohibited. Sec. 35. ONE TRAY STREETS AND AT.L.-EYS. When signs are erected on one way streets or in any alley giving notice thereof no person shall drive any vehicle in a direction contrary thereto. ARTICLE V-1. SPECIAL STOPS REQ-U--LF M Sec. 3E. THE TRAFFIC AUTHORITY TO ERECT STOP SIGNS. Whenever any ordinance or resolution of this city designates and describes any street or portion thereof as a through street, or any intersection at which vehicles are required to stop at one or more entrances thereto, the Traffic Authority shall erect and maintain stop signs as follows: A stop sign shall be erected on each and every street intersecting such through street or portion thereof so desig_rated and at those entrances of o .Ler intersections where a stop is required. Every such sign shall be placed at or near the entrance to the highway or intersection where a stop is required and every such sign shall conform to the requirements of the Vehicle Code. - 8 - Sec. 37. STOP, AT TMOUGH STIMET CH STOP INTERSECTION. (a) Those streets and parts of streets described in Section 81 here- of are hereby declared to be through streets for the purpose of this section. (b) When stop signs are erected as herein provided; at the entrance to any intersections, every driver of a vehicle shall stop at every such sign; before entering the inter- section, except when directed to proceed by a police officer or traffic control signal. Sec. 38. EIMERGING FRO171 ALLEY CR PEIVATL DR.IVEi'IAY. The driver of a vehicle emerging from an alley, driveway or building, shall stop such vehicle immediately prior to driving onto a side- wally or into the sideway area exterd ing across any alley way. RT L C" DTI I iVIISCMLA., SOUS DRIVING R[ LIES Sec. 39. I ~~TRrFE_~yCE WITH FIRE APPARATUS. (a) No driver of a vehicle shall follow any fire apparatus answering a fire alarm, closer than 500 feet, or oark any vehicle within 500 feet of a fire, or operate or pare any vehicle in such manner as to interfere with any fire apparatus or line of fire hose when in use at a fire or when in place for use in response to a fire alarm. (b) No vehicle shall be driven over any unprotected hose of the Eire Department when laid do-vvn on any street, or private driveway, to be used at any fire; or alarm of fire, vvithout the cO aserit of the afficials of the Fire Depa~~ t ?ent in command. Sec. 40. DRIV-L--r G '1H ROUGH FNTRAL PROCESSIO1-,S. No driver of a vehicle shall drive between the vehicles comPrisi==g a funeral procession while they are in motion and voPhen the vehicles in such procession are conspicuously so desigrated. This provision shall not apply 9 - at intersections where traffic is controlled by official traffic signals or police officers. Sec. 41. RIDING ON MOTORCYCLES AND BICYCLES. A person operating a motorcycle or bicycle shall not ride other than upon the permanent and regular seat attached thereto2 nor carry any other person upon such motorcycle or bicycle other than upon a firmly attached seat to the rear of the operator; nor shall any person ride upon a motorcycle or bicycle ocher than as above authorized. Sec. 42. CLINGING TO MOVING VEHICLE. Any person riding upon any bicycle a amotorcycle, coaster2 roller skates or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. Sec. 43. VEHICLES SLULL NOT BE DRIVEN ON'THE SIDEWALK. The driver of a vehicle shall not drive within any sidewalk area or any parkway except at a permanent or temporary driveway.. Sec. 44. NEW PAVEMENT. No person shall ride or drive any animal or any vehicle over or across any newly made pavement or freshly painted marking in any street when a barrier or sign is in place warning persons not to drive over or across such pavement or marking, or when a sign is in place stating that the street or any portion thereof is closed. ARTICLE VIII. RESTRICTED USE OF CERTAIN STREETS Sec. 45. CERTAIN DELIVERIES PROHIBITED. No person shall deliver goods a wares' or merchandise from any truck? dray 2 or other vehicle employed the business of delivering such goods2 wares' and merchandise to any Aimises upon that portion- of Forth Santa Cruz Avenue 7 between. South Santa Cruz Avenue and the intersection of North Santa Cruz Avenue and Nicholson Avenues between the hours of 9:00 A. M.. and 6:00 P. lip of any day. Sec. 46.. ADVERTISING VEHICLES. No person shall operate or drive any - 10 - vehicle used for advertising purposes or any advertising vehicle equipped with a sound-amplifying or loud-speaking device upon any street or alley at any time within the Central Traffic District, without special permisssion from the Traffic Author-L ARTICLE IX. PEDESTRIANS. Sec. 47. THE TRAFFIC AUTHORITY TO ESTABLISH CROSSWALKS. (a) The Traffic Authority shall establish, designate and maintain crosswalks at intersections and other places by appropriate devices, marks or lines upon the surface of the roadway as follows: Crosswalks shall be established and maintained aet, all intersections within the Central Traffic District and at such intersections outside such district.' and at other: places within or outside said district. where the Traffic Authority determines that there is particular hazard to pedestrians crossing the roadway, subject. to the limitation contained in (b) of this section. (b) Other than crosswalks at intersections, no c ross- walk shall be established in any block which is less than four hundred (400) feet in length. Elsewhere not more than one additional crosswalk shall be established in any one block and such crosswalk shall be located as nearly as practicable at mid-block.. Sec. 48. CROSSING IN CENTRAL TRAFFIC DISTRICT. No pedestrian.shall cross a roadway other than by a crosswalk in the Central -Traffic District or in any business district, Sec. 49. CROSSING AT RIGHT ANGLES. No pedestrian shall cross a roadway at any place other than by a route at right angles to the curbs or by the shortest route to the opposite curb, except in a amarked. crosswalk. Sec. 50. STANDING IN ROADWAYS. No person shall stand in any roadway other than. in a safety zone, or in a crosswalk2 if such action interferes with the lawful movement of traffic, - IT - This provision shall not apply to any public officer or employee, or employee of a public utility when necessarily upon.a street.. in.line of duty. ARTICLE' X. RAILWAY TRAINS_ AN'D VEHICLES Sec. 51. TRAINS NOT TO BLOCK STREETS. No person shall operate any train or train of cars, or permit the same to remain standing, so as to block the movement of traffic upon. any street for a period of time longer than five (5) minutes. Eh' Sec. 52. BOARDING OR ALIGBTING FROM A VHEICLE. No person shall board or alight from any vehicle while such vehicle is in motiono Sec. 53. UNLA °UL RIDING. No person shall ride on any vehicle upon any portion thereof not designed or intended for the use of passengers. This provision shall not apply to an employee engaged in the necessary discharge of a duty, or to persons riding within truck bodies in space intended for merchandise. Sec. 54. RA.IL16AY GATES. No person shall drive any vehicle through or under any safety gate or railroad barrier which is maintained at a railroad crossing for the purpose of warn- ing persons of the approach of a train or car, while such gate or barrier is closed or while it is~being opened or closed. See. 55. VEHICLES TO BE CONSTRUCTED TO PREVENT SIBTIJUG OR SPILLING OF CONTENTS. No vehicle used for the purpose of carrying sand, gravel, earth, rock, or manure, or any other loose or liquid substance liable to sift or.spill out shall be allowed in any of the streets of the Town of Los Gatos unless the same is made tight and so constructed as to prevent the sifting or spilling of any of its contents along any of the streets over which it is passing, and no person shall operate or drive any such vehicle unless - 12 - said vehicle is so constructed as to prevent the sifting or spilling of any of its contents upon the streets as eoresaid, ARTICLE XI METHOD OF PARKING See. 56. PARAI•E _EL WITH CLIMB ® EXCEPTIONS. No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of traffic and with the right hand wheels of the vehicle within eighteen (18) inches of the curb line or edge of the roadway, except as follows: (a) Upon those streets which have been marked or signed by the Traffic Authority for angle parking' upon which streets vehicles shall be parked at the angle to the curb indicated by such marks or signs. (b) Upon those streets where parking on the left side of the roadway, or otherwise is specifically provided by ordinance Sec. 57. THE TRAFFIC AUTHORITY TO INDICATE ANGLE, PAERKING. The Traffic Authority is hereby authorized to determine those streets - upOn.which angle parking shall be permitted (other than state highways where such parking is prohibited by the State Vehicle Code) and shall indicate all such places by placing white lines upon the surface of the roadway indicating the angle at which parking is permittedm. ARTICLE XI I STOPPING a STANDINGa A111M PARKING Sec. 58. APPLICATION OF ORDINANCE. (a) The provisions of this ordin- ance prohibiting the stopping2 standing or parking of a, vehicle shall apply at all timed or at those tires herein specified except when it is necessary to stop a vehicle to avoid con- flict with other traffic' or in compliance with the directions of a police officer or official traffic control device. (b) The provisions of this ordinance imposing a time limit ® 13 on standing or parking shall not relieve any person from-the duty to observe other and more restrictive provisions hereof9 or of law, prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. Sec. 59. STOPPING OR SMIDING PROaiIBITED - o SIGNS REQUIRED. No person shall stop, stand or park a vehicle in any of the following places: 1. Within any tunnel or upon.any bridges viaduct or approach thereto. 2. Within any parkway. Sec. 60. TI-M TRAFFIC AU'I'HORMY TO ERECT SIGNS. The Traffic AuthGrity shall appropriately sign or mark the following-placessand when so signed or marked s no person shall stops stand or park a vehicle in any of said places. 1. At any place within -f1-1 ftn (15 feet of an inter- section roadway in the Central. traffic District or in any business district except that a bus may stop.at a designated bus stop. See. 61. TEE TRAFFIC AUTHORITY'. MAY PLACE "NO STA1aING~~ SIGNS OR YMRK a a The Traffic AtLthority may appropriately sign or mark the following places, and when so signed or: marked; no person shall stop, stand or park. a vehicle in any of said places. 1. At any place between the portal of a tunnel and the nearest street intersection.. Sec. 62. CURB YARKINGS TO INDICATE NO STOPPING A%D PAI KING REGUITATIONS (a) The Traffic Authority is hereby authorizedg subject to the provisions and limitations of this ordinances to places and when required herein. shall places the following curb markings to indicate parking or standing regulations, and said curb markings shall have the meanings as herein set forth, 14 1. Red shall mean no stopping, standing or parking at any time except that a bus may stop in a red zone marked or signed as a bus zone. 2. Yellow shall mean no stopping, standing or parking at any time between 7:00 A. M. and 6:00 P. M. of any day except Sunday for any pur- pose, other that the loading or unloading of passengers or materials, provided that'the loading or unloading of passengers shall not consume more than three (3) minutes nor the loading or unloading of materials more than twenty (20) minutes. 3. White shall mean no stopping, standing or parking for any pur- pose other than loading or unloading of passengers, which shall not exceed three (3) minutes and such restrictions shall apply between seven A. M. and six P. M. of any day except Sunday and except as follows: When such zone is in front of a hotel, the restrictions shall apply at all times; When such zone is in front of a.theater, the restrictions shall apply at all times except when such theater is closed. 4. Green.shall mean no standing or parking for longer than twenty (20) minutes at any time between 7:00 A. M. and 6:00 P. ~ii.® of any day except Sunday. (a) Provided that the Traffic thority may designate a shorter period, but not less than five (5) minnutes, when in its opinion such shorter period would be in the public interest. In the event that the Traffic Authority shall fix a shorter period, the number of minutes so fixed by it shall be stencilled upon the top of the curb. (b) When the Traffic .,authority, as authorized under this ordinance, has caused curb markings to be placed, no person shall stop, stand or park a vehicle adjacent to such legible curb marking in viola- Lion of any of the provisions of this section.. ARTICLE XIII STOPPING FOR LOADING OR UNLOADING ORLY Sec. 63. THE TRAFFIC AUTHORITY TO ESTAD ,I.SH LOADING ZOV'ES. (a) The Traffic Authority is hereby authorized to determine and mark loading zones and passenger loading zones as followso- 1. At. any place in the Central Traffic District or any business district. - 15 - 2m Elsewhere in front of the entrance to any place of business or in front of any hall or place used for the purpose of public assembly. (b) In no event shall more than one-half of the total curb length in any block be reserved for lading zone purposes ex- clusive of the passenger loading zones at the entrances to public theaters. (c) Loading zones shall be indicated by a yellow paint line stenciled with black letters, 'LOADING 01MV2 upon the tops of all curbs within such zones.. (d) Pia"asenger loading zones shall be indicated by a white line stenciled with black letters, "PASSENGER LOADING ONLY"2 upon the tops of all cubs in said zones. See. 64. DELIVERIES ON NOR SANTA CRUZ AVENUE: No person shall stop or stand a commercial vehicle upon Forth Santa Cruz Avenue between Nicholson Avenue and South Santa Cruz Avenue, between the hours of 9:30 A. M. and 6:30 P. M. of any day for the purpose of making any commercial delivery of goods, waresa or merchandise therefrom. Sec. 65. EFFECT OF PERAUSSION TO LOAD OR.UNLOAD. (a) Permission herein granted to stop or stand a vehicle for purposes of loading or unloading of materials shall apply only to commercial vehicles and shall not-expend beyond the time necessary therefor, and in no event for more than twenty (20) minutes. (b) The loading or unloading of materials shall apply only to commercial deliveries, also the delivery or pickup of express and parcel post packages and United States mail. (c) Permission herein granted to stop or park for purposes of loading or unloading passengers shall include the loading or unloading of personal baggage but shall not extend beyond the time necessary therefor and in no event for more than three (3) *inutes0 (d) Within the total time limits above specified2 the pro- - 16 visions of this section shell be enforced so as to accom- -modate necessary and reasonable loading or unloading but without permitting abuse if the privileges hereby granted. Sec. 66. STA1,1)_3T.1iG !_TT ANL Y ALLEY. No person shall stop, stand or park a vehicle for any purpose other than the loading or unloading of persons or materials in any alley. Sec. 67. STANDING FOR LOADING OR v7LOADINGG LY. When authorized signs or marks are in place giving notice thereof, no person shall stop' stand or park a vehicle for any purpose other than loading or unloading passengers or materials for such time as is permitted herein; in any of the following places: 1. In any yellow loading zone; 2. Within. fifty (Q feet of ahy enhance to any school. Sec. 68. STATZD_NG IN ?ASSENGEa LOADING ZONE. No person shall stop, stand or park a vehicle in any passenger loading zone for any purpose other than-the loading or unloading of passengers for such time as is specified in Section 64. See. 69. THE TRAFFIC AUTO G'LI TY TO DET:ER22:NE, ADDITIONAL LOADING OEH TULOADING PIECES. Whenever the Traffic Authority has deter- mined that parking shall be limited and authorized signs or marks are in place giving notice thereof, no person shall stop, s Land or park a vehicle for any purpose other than loading or unloading passengers or materials it any of the following places 1. At any curb where the grade of the street exceeds helve (12) per cent. 2. On any part of a roadway having a width of not more than twenty-five (25) feet. 3. In front of any hall or place used for the purpose of public assemblage. 4. In front of the entrance to any place in use for business outside of the Central Traffic District.. - 17-- 5. At any other place where the parking of vehicles would result in traffic congestion or particular hazard. Sec. 70. BUS ZONES TO BE ESTABLISHED. (a) The Traffic Authority is hereby authorized to establish bus zones opposite curb space for the loading and unloading of buses of common carriers of passengers engaged in local transportation, and to determine the location.thereof. (b) Yo bus zone shall exceed fifty (50) feet in length except that when satisfactory evidence has been presented to said Traffic authority showing the necessity therefor, said Traffic Authority may extend bus zones in such places not to exceed one hundred twenty-five (325) feet in length. (c) The Traffic Authority shall paint a red line stencil with white letters, "NO STANDING", together with the words, "13U3 ZCNExe, upon the tops of all curbs and places specified as a bus zone. ARTICLE XIV. PARKING PROHIBITED OR. LIlVETED Sec. 71. PARKING TIME LIX TED IN CEI'UR.AL TRAFFIC DISTRICT. When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicle within the Central Traffic District between the hours of 7000 A. M. and 6.00 F. V_., except Sunday, for a period of time longer than one (1) hour. Sec. 72. PING TIME LIMITED IN OTHER. BUSUNESS DISTRICTS. When authorized signs are in place giving notice thersof, no person shall stop, stand or park any vehicle within a business district outside of the Central Traffic District between the hours of 7.00 A. M. and 6:00 P. M. of any day, except Sunday, for .a period of time longer than one (1) hour. Sec. 73. ALL NIGHT PARKING PROHIBITED. No person shall stop, stand or park a vehicle on any street within the Central Traffic District for a period of time longer than thirty (30) minutes between the hours of 2.00 A. M. and '4®00 A. M. of any day. - 1g - Sec. 74. MULAISFUIL PARKING - PEBDI IRS , VENDORS. (a) Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon or push-cart from which goods, wares, merchandise, fruits, vegetables or food stuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunch wagon or eating car or vehicle, on any portion of any street within this Town., except that such vehicles, wagons or push-carts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten (14) minutes at any one place. The provisions of this sub-section shall not apply to persons delivering such articles upon order of, or by agreement with a customer from a store: or other fixed place of business or distri- bution. (b) No person shall park or stand on any street, any lunch wagon, eating cart or vehicle, or push-cart from which tamales., peanuts, popcorn., candy or other, articles of food, or any amerchandise, are sold or offered for sale without first obtaining a written permit to do so from the Tbwn. Council of the Town of Los Gatos, which permit shall designate the specific location in which such cart or vehicle shall stand. (c) No person shall park or stand any vehicle, or wagon, used or intended to be used in the transportation of persons or property for hire, on any street, while await ing patronage for such vehicle or wagon without first obtain- ing a written permit to do so from the Town Council of the Town of Los Gatos which shall designate the specific location where such vehicle shall stand. (d) No person shall stand or park a vehicle upon any street for the purpose of displaying such vehicle for sale by sign or otherwise. - 19 (e) Whenever any permit is granted under the provisions of this section and a particular location to park or stand is specified therein' no person shall park or stand any vehicle, wagon, or push-cart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, such permit shall be forthwith revoked by the Town Council upon the filing of the record of such conviction with the Town.Council, and no permit shall thereafter be issued to such person until six (6) months have elapsed from the date of such revocation. Sec. 75. WASHING VEHICLES IN STREET. No person shall dust, wipe. wash2 or, otherwise clean, use-or employ any method of dusting, wiping, washing or otherwise cleaning any vehicle, or portion thereof, while on any street unless such vehicle is owned by or under the direct control or supervision of the person doing any of the acts herein enumerated. Sec® 76. EMERGENCY PARKING SIGNS. (a) Whenever the Traffic Authority shall determine that an emergency traffic congestion is likely to result from the holding of public or private assemblages' gatherings or functions, or for other reasons, the Traffic Authority shall have power and authority to order temporary signs to be erected or posted, indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the Traffic Author shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the Traffic authority shall cause such signs to. be removed promptly thereafter. (b) When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions 2 0 - and provisions of such signs. ARTICLE XV. PENALTIES AND EFFECT OF ORDINANCE Sec. 77. PENALTIES. Any person etiolating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the county jail for not exceeding three (3) months, or by a fine of not to exceed three hundred dollars ($300.00), cr by both such fine and imprisonment. Sec. 78. EFFECT OF ORDINANCE. If any section, subsection., sentence, clause- or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Town Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Sec. 79. REPEAL. Ordinance Na, 178 and Ordinance No. 236 of this Town are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecu- tion or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Sec. 80. PUBI,ICATION 0 ORDIINANCE. The Town Clerk shall cause this ordinance to be published in Los L r A /L " . w a newspaper of general circulation., printed and published in the Town of Los Gatos. Main Street; South Santa Cruz Avenue; North Santa. Cruz. Avenue; Saratoga Avenue v.1esterly from the Westerly line of North Santa Cruz Avenue; University Avenue from. st Main Street. to the northerly line of Royce Street; Pennsylvania from Bay Vier Avenue to the westerly Town Limits.
