ORDINANCE AMENDING CHAPTER 24 OF THE TOWN CODE
TO (1) ALLOW TERMINATION OF AUTOMATIC STAY;
(2) DELETE THE PROVISION ALLOWING COSTS TO BE AWARDED;
(3) ATTACH CONDITIONS TO ALLOWANCE OF DEBT SERVICE COSTS;
AND (4) REQUIRE LANDLORDS TO NOTIFY TENANTS OF THEIR RIGHTS TO PETITION
The Town Council of the Town of Los Gatos hereby ORDAINS:
SF.(TION 1 .
Section 24.50.015 of the Town Code is amended to read as follows:
"Invocation by a tenant or landlord of conciliation under this
ordinance shall stay the rent increase or eviction complained of,
and any court proceedings based thereon, pending resolution of the
dispute; rovided; that if staff and a mediator determine, based on

rent increase is determined to be reasonable hereunder, retroactive
to the date the original increase proposed by the landlord would
have been effective."
SECTION 2.
Section 24.40.055 of the Town Code, containing the following language,
is deleted:

Section 24.70.020(2) is amended to read as follows:
"Increased costs of debt service shall be deemed reasonable
and allowed by the Hearing Officer where the aggregate amount of
debt fran whence they arise constitutes no more than 707 of the
value of the property as established by a lender's appraisal, and
no more than 80% of the cost of such debt service is being passed
through to the tenants; provided, the Hearing Officer finds that
that debt is a secured, arms -1 t transaction. Mere no en 's
appraisal is available, the Hearing Officer may secure such appraisal
to be paid for by the landlord as a cost of maintenance and operation."

Section 24.30.030 is added to the Town Code to read as follows:
"No rent increase in excess of that allowed under 24.70.015(3)
hereof shall be effective unless the landlord serves, with the
notice of proposed increase, written notice advising the affected
tenants of their right to petition for conciliation under 24.40.010,
and giving the current phone number of the agency administering the
ordinance for the Town."
SECTION 5.
This Ordinance takes effect 30 days after the date it is adopted. Within
15 days after this ordinance is adopted, the Town Clerk shall cause it to be pub-
lished once in a newspaper of general circulation published and circulated in the
Town.
This ordinance was introduced at a regular meeting of the Town Council
of the Town of Los Gatos on June 7th. 1982 , and adopted by the
following vote as an ordinance of the Town of Los Gatos at a regular meeting
of the Town Council on June 21st, 1982
