Ord 1513-AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 52 FROM RM: 5-20-R-LPH TO R-1D-LPH-PDORDINANCE NO. 1513 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 52 FROM RM:5 -20 -R -LHP TO R -lD- LHP -PD THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: SECTION 1. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property located at the Southeast corner of Nicholson and Wilder Avenues shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from RM:5 -20 -R -LHP (Multiple Family Residential, 5 -20 units per net acre - Rehabiliation Overlay - Landmark and Historic Preservation Overlay Zones) to R -1D- LHP -PD (Single Family Residential, Downtown - Landmark and Historic Preservation Overlay - Planned Development Overlay Zones). SECTION 2. The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. Four (4) rental dwelling units for low income senior citizens. 2. Parking for the units at a ratio of 1 space per unit minimum. 3. Landscaping, parking and other improvements shown and required on the Official Development Plan. 4. Uses permitted are those specified in the RM (Multiple Family) zone of section 4.32.020 (Permitted Uses) and 4.32.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in section 4.32.030 is allowed unless specifically authorized by this ordinance, or by conditional use permit. SECTION 3. COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION 4. COMPLIANCE WITH HISTORIC DISTRICT All provisions of Ord. 1463 creating and regulating the Almond Grove Historic District apply except when the Official Development Plan specifically shows otherwise. SECTION 5. ARCHITECTURE AND SITE APPROVAL Architecture and site approval is required before any grading or construction work is performed, whether or not a Permit is required for the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with section 4.82.120 of the Zoning Ordinance. SECTION 6. PERFORMANCE STANDARDS In addition to Exhibit A, the attached Exhibit 6 (Preliminary Development Plan and Elevations) are a part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits or upon occupancy as appropriate. 1. Residence in this project shall be restricted to persons who are sixty years of age or older, or married couples living together when at least one spouse is sixty years of age or older. Higher minimum age limits established by private restrictions are per- missible. 2. Occupancy of the units shall be in accordance with the following preference: (1) FIRST PREFERENCE: Senior citizens who live in the Town of Los Gatos. (2) SECOND PREFERENCE: Senior citizens who have lived in the Town of Los Gatos. (3) THIRD PREFERENCE: All other senior citizens eligible according to income criteria. 3. The units shall remain as rental units exclusively for residence by low- income senior citizens in accordance with the income criteria as specified by the Town Council. - 2 - 4. The property owner shall by separate, recorded instrument, in language satisfactory to the Town Attorney, agree with the Town on his own behalf and in a manner binding their successors in interest that the land will be subject to the age restrictions and occupancy preferences specified in this ordinance until the Town consents otherwise, and that in the event of litigation to enforce the restrictions he and his successors will pay the Town expenses and attorney's fees. 5. The property owner shall guarantee by contract and bond, the follow- ing improvements, to the satisfaction of the Town Engineer: a. Repair all broken and cracked sections of curb, gutter and sidewalk. b. Install wheel chair ramp at intersection. c. Install 2 electroliers (70 watt, high pressure sodium). 6. Plans to be submitted for architectural and site approval shall include: a. Grading and drainage plans showing proposed pad and floor elevations and showing existing elevations. Drainage plan area should show perimeter drainage around buildings and parking area. b. Utility plan for sanitary sewer and water. c. Details of building materials, colors, and landscaping. - 3 - SECTION 7. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. The foregoing ordinance was duly and regularly introduced at a regular meeting of the Town Council of the Town of Los Gatos held on the 3rd day of August , 1981.
