RESOLUTION CALLING FOR SEALED PROPOSALS
UNDER RESOLUTION OF INTENTION ADOPTED
SEPTEMBER 13, 1948, AS AMENDED
RESOLVED, by the Town Council of the Town of Los Gatos,
California, that
WHEREAS, the Town Council of said Town did, on the 7th
day of February, 1949, adopt a resolution of preliminary approval
of the engineer's report, wherein it did preliminarily order the
construction of certain public improvements in and for a portion
of said Town, and an assessment and diagram to be confirmed in
accordance with a total and itemized estimate of the costs and
expenses thereof, all as more particularly described and set
forth in Resolution of Intention adopted by said Council on
September 13, 1948, as amended and as proposed to be changed and
modified by Resolution of Intention to Change and Modify, adopted,
March 21, 1949.
NOW, THEREFORE, the Town Clerk of said Town is hereby
directed to publish by two successive insertions in the Los Gatos
Mail News, a newspaper published and circulated in said Town,
a notice inviting sealed proposals or bids for the construction
of said improvements, and referring to the plans and specifica-
tions on file in the office of said Town Clerk , and as proposed
to be modified, the first of which publications shall be at
least ten days prior to the time fixed for the opening of bids.
Said Clerk is also directed to mail copies of said notice to the
Daily Construction News, 333 Kearny Street, San Francisco,
California, and to Daily Pacific Builder, 465 Tenth Street,
San Francisco, California, at least ten days before the day fixed

to ten per cent of the bid, or by a bond in said amount and
payable to said Town, signed by the bidder and two sureties who
shall justify before any officer competent to administer an oath,
In double said amount, and over and above all statutory exemptior.
Said check shall be forfeited or said bonds shall become payable
to said Town in case the bidder depositing the same does not,
within fifteen days after written notice that the contract has
been awarded to him, enter into a contract with said Town.
Said sealed proposals or bids shall be delivered to the
Town Clerk of said Town of Los Gatos on or before 8:00 o'clock
P. M. of Monday, the 4th day of April, 1949, in the Council
Chambers of the Town Hall, Los Gatos, California, said time
being not less than ten days from the time of the publication
and mailing of said notices. Bids shall be publicly opened,
examined anddeclared on said day and hour.
I hereby certify that the foregoing resolution was duly
and regularly adopted and passed by the Town Council of the Town
of Los Gatos, California, at a regular meeting thereof held on
the 21st day of March , 19490 by the following vote:
