1949-14-Preliminary Decision Under Division 4 Of The Streets And Highways Code-Street Improvement Project- I KCS:JM 3/15/49/5 RESOLUTION DETERMINING NOT TO TAKE PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE, IN PRO- CEEDINGS FOR THE IMPROVEMENT OF CER- TAIN STREETS STREET IMPROVEMENT PROJECT RESOLVED, by the Town Council of the Town of Los Gatos, California, that WHEREAS, all of the owners of more than 60% in area of the property subject to assessment therefor have signed and filed with the Clerk of this Council a petition for the construction of certain improvements and assessing the cost thereof upon the lands benefited thereby, and waiving proceedings under Division 4 of the Streets and Highways Code, which improvements are more particularly described in Exhibit "A" hereto attached and by reference made a part hereof, and which lands to be assessed are more particularly described in Exhibit "B" hereto attached and by reference made a part hereof; and WHEREAS, the public interest and convenience will be served by the taking of said proceedings. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows: 1. That the owners of more than 60% in area of the prope subject to assessment for said proposed improvements have signed and filed with the Clerk of said Council written petitions for said improvements and waiver of said investigation proceedings; 2. That the public interest andoonvenience require that this Council undertake proceedings for the construction of said improvements by including them in the work to be done under its Resolution of Intention to Acquire and Construct Certain Improve- - n I hereby certify that the foregoing resolution was duly and regularly adopted and passed by the Town Council of the Town of Los Gatos, California, at a regular meeting thereof held on the I 4A day of / ✓ , 1949s by the following vote of the members thereof: AYES, and in favor thereof, Councilmen:,�J NOES, Councilmen: ABSENT, Councilmen: /)� OVED: o n er EXHIBIT "A" AtIF 1. That Jones Road between College War and the southerly line of Canyon View Terrace Subdivision, including intersections, be improved by grading and constructing therein water -bound rock macadam base pavement with asphaltic wearing surface, concrete storm drain pipe with valley gutter at intersection with Euclid Avenue, sanitary sewer mains with house sewer laterals, manholes and risers. 2. That Euclid Avenue for its entire length, including intersections, be improved by grading and constructing therein water -bound rock macadam base pavement with asphaltic wearing surface, rolled concrete curbs and gutters, storm drain pipe with catch basins in said street and in right of way to be acquired as shown on map on file, sanitary sewer mains, manholes, riser and house sewer laterals. 3. That Oak Grove Way for its entire length, including intersections, be improved by grading and constructing therein water -bound rock macadam base pavement with asphaltic wearing surface, rolled concrete curbs and gutters excepting for steep portion thereof, sanitary sewer mains terminating at a point on the westerly line thereof with provision for future connection with main trunk sewer, together with house sewer laterals, man- holes, riser and catch basins, concrete storm drain pipe across said road and through right of way to be acquired as shown on map thereof on file in the office of the Town Clerk, and an underground tile drainage system along the easterly side of said street for approximately 500 feet from the southerly end thereof. 4. That Pageant Way for its entire length be improved by constructing therein water -bound rock macadam base pavement with EXHIBIT "B" BEGINNING at the intersection of the west line of that portion of College Avenue formerly known as Wilcox Avenue with the southerly line of East Main Street; thence in a general southerly, westerly and easterly direction fol- lowing the said westerly line of College Avenue to the northerly line of the Canyon View Terrace Subdivision; thence easterly and southerly along the northerly and westerly exterior boundary of said subdivision to the northwesterly corner of Tract 330; thence southerly and easterly along the westerly and southerly line of said tract, the continuation thereof easterly as the southerly line of Canyon View Terrace Subdivision, and the continua- tion of said southerly line easterly to the westerly line of the Flume right of way of the San Jose Water Works; thence in a general northerly and easterly direction along said westerly line to the center line of College Avenue; thence northerly along said center line to a point dis- tant thereon 659.44 feet southeasterly from the intersec- tion thereof with the easterly extension of the northerly line of the Canyon View Terrace Subdivision; thence South 360 18' 02" West 105.13 feet North 500 49' 24" West 94.42 feet, North 65° 43' 40' West 172.16 feet, North 260 10' 30" West 115.65 feet, North 10 04' 35" West 138.14 feet, North 350 48' 17" East 106.14 feet, and North 87° 37' 57 East 151.70 feet to the easterly line of College Avenue; thence in a general northerly and easterly direction along said easterly line of College Avenue and the continuation thereof along the street formerly known as Wilcox Avenue to the southerly line of East Main Street; thence easterly* along said southerly line which line is also a boundary line of the assessment district under Resolution dated 13 September 1948, as amended, to a p�)int on the southerly line of East Main Street distant thereon 100 feet westerly from the west- erly line of Pageant Way (formerly known as Seanor Street) and running thence southerly along the westerly line of the land now or formerly of Spotswood and continuing on the pro- jection southerly of said westerly line to the southerly line of lands now or formerly of Gallant, thence southerly along the northwesterly and westerly line of said land of Gallant to the northerly line of Villa Avenue, thence easterly along the northerly line of Villa Avenue to a point distant thereon 100 feet easterly from the easterly line of Pageant Way, thence northerly to a point on the southerly line of East Main Street distant thereon 100 feet easterly from the east- erly line of Pageant Way, and continuing northerly along the northerly projection of said line to the northerly line of East Main Street, thence westerly along said northerly line which line is also a boundary line of the assessment district under Resolution dated 13 September 1948, as amended, to the projection northerly of the westerly line of said College Avenue, thence southerly along said northerly projection to the point of beginning.
