RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING THE PURCHASE OR RIGHT -OF -WAY IN ADVANCE OF
REVISED FREEWAY AGREEMENTS FOR THE
ROUTE 85/17 FREEWAY INTERCHANGE
WHEREAS, the Santa Clara County Traffic Authority desires to begin
timely purchases of real estate for the Route 85/17 freeway interchange where
alignment is not an issue; and
WHEREAS, any delay in the purchase of property required for the
project will result in additional costs because of escalating real estate
values; and
WHEREAS, Section 100.21 of the Streets and Highway Code provides that
a "a City Council may, by resolution, authorize the purchase of right -of -way
prior to approval of an agreement, if the purchase is limited to the mainline
corridor of the proposed freeway and the alignment of the freeway is not at
issue "; and
WHEREAS, the Town Council at a meeting on February 13, 1989, selected
an alternative which includes a full interchange at Bascom Avenue and no
interchange at Winchester Boulevard; and
WHEREAS, after an extensive public hearing the Town Council determined
that Alternative 9E is in the best interests of the Town of Los Gatos; and
WHEREAS, the Traffic Authority desires to begin final design of the
interchange complex and completion of the necessary right -of -way acquisition,
based on the alternative selected; and
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of
Los Gatos hereby authorizes the acquisition of properties located in the
mainline corridor of the Route 85/17 freeway interchange, which the Council
determines to include the direct freeway -to- freeway connections for the
interchange, within the following limits:
Route 85, from Winchester Boulevard to Bascom Avenue
Route 17, from Camden Avenue to Blossom Hill Road
and located within the Town of Los Gatos, consistent with Alternative 9E.

BE IT FURTHER RESOLVED, that this authorization does not include the
acquisition for the access to the northwest quadrant of the Route 85/17
interchange.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 21st day of February , 1989
by the following vote:
