1988-024-Denial Of One-Year Time Extension For Construction Of Commercial Building In The C-2 ZoneRESOLUTION NO: 1988 -24 RESOLUTION GRANTING APPEAL OF PLANNING COMMISSION DENIAL OF ONE -YEAR TIME EXTENSION FOR CONSTRUCTION OF COMMERCIAL BUILDING IN THE C -2 ZONE (100 NORTH SANTA CRUZ AVENUE - GARY AND DORIS ZUCCONI) WHEREAS: A. Gary Zucconi has appealed a decision of the Planning Commission as follows: Denial of one -year time extension for construction of a commercial building in the C -2 Zone on property located at 100 North Santa Cruz Avenue and owned by Gary and Doris Zucconi (Architecture and Site Application S- 88 -19B); and B. A public hearing was set before the Town Council on September 21, 1987, continued to November 2, 1987, and continued to and held on January 4, 1988. IT IS HEREBY RESOLVED: A. The Town Council hereby finds that the circumstances regarding traffic impact have changed with the adoption of the revised traffic policy. B. The Town Council hereby further finds that the traffic impact of this project is excepted from the revised traffic impact policy as adopted by the Town Council. C. The Town Council hereby further finds that the issue of on -site parking is resolved with a revised condition. D. Based on the foregoing, the appeal is hereby granted and the one -year extension of the Architecture and Site approval is granted until August 28, 1988 with the following modified conditions. 1. No building permits shall be issued for the approved proposal until such time as the Parking District is formed, the Bonds sold, and construction has begun. 2. Final grading, drainage, sanitary sewer and lighting plans shall be provided to the satisfaction of the Town Engineer. 3. The existing sidewalk along the Santa Cruz Avenue frontage shall be replaced to conform to the Villa Hermosa Theme to the satisfaction of the Town Engineer. 4. The existing driveway at the northerly end of the frontage shall be removed and replaced with new curb, gutter, and Villa Hermosa theme sidewalk to the satisfaction of the Town Engineer. 5. Any work in the public right -of -way will require an Encroachment Permit, to the satisfaction of the Town Engineer. 6. A well information questionnaire (available through the Town Engineer) shall be completed to the satisfaction of the Town Engineer. %. This approval is valid until August 28, 1988, one year from the expiration date of the previous extension. Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. -2- PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 19 day of January 1988 by the following vote.
