1988-005-Town Policy Regulating Residential Development With Unmitigated Traffic ImpactsRESOLUTION NO. 1988 -5 TOWN POLICY REGULATING RESIDENTIAL DEVELOPMENT WITH UNMITIGATED TRAFFIC IMPACTS WHEREAS, the Town Council of the Town of Los Gatos intends to limit the traffic generated from new development to the greatest extent possible while attempting to fulfill the Town's projected housing need as identified in the General Plan. WHEREAS, it is necessary to adopt policy that would regulate residential development on vacant property and lot splits on property designated for residential use. WHEREAS, this policy shall be considered in addition to the policies established in the General Plan, Downtown Specific Plan and Hillside Specific Plan and the regulations set forth in the Zoning Ordinance. RESOLVED, that the Town Council of the Town of Los Gatos does hereby adopt the following as the policy regulating residential development with unmitigated traffic impacts in the Town of Los Gatos: A. Residential Development on Vacant Property. Any residential project (i.e. subdivision, multiple family residential development, Planned Development, etc.) with unmitigated traffic impacts may be approved on a vacant parcel providing the project complies with all of the following requirements: 1. The project does not exceed 50% of the density allowed by the Zoning Ordinance and /or General Plan. 2. The project significantly fulfills at least one of the policies of the General Plan Housing Element. 3. The project will contribute an in -lieu fee for construction of proposed capacity improvements wherever traffic impacts attributable to the project occurs. A vacant property is any property that is not improved with any structures. B. Residential Lot Splits on Developed Property. If the lot split generates an unmitigatible traffic impact, a parcel designated for residential use which has an existing single family dwelling may be divided into a maximum of two lots as long as the division complies with all of the following criteria and would permit the construction of only one additional single family dwelling: 1. The lot split shall not create a corridor lot, unless the property could also be divided in a manner that conforms with all Town regulations (including Items 2 -5 below) and the Planning Commission shall make a finding that the corridor lot is the superior design by reducing the amount of grading and /or the amount of vegetation to be removed. 2. The lot split would not result in a new parcel that is incompatible with the size, shape and configuration of the other parcels in the neighborhood. 3. The lot split would not result in the removal of more than a minimal amount of existing vegetation. 4. The lot split would not result in a significant amount of grading. 5. The lot split would not require the alteration and /or demolition of all or any portion of the existing dwelling nor would the lot split require that the existing dwelling be moved.
