ORDER VACATING A SIDEWALK EASEMENT ALONG
NORTH SANTA CRUZ AVENUE AND ELM STREET
WHEREAS, the Town Council of the Town of Los Gatos has proceeded under the
provisions of Division 9, Part 3 (Section 8300 through 8363) of the Streets and
Highways Code, concerning vacation of a sidewalk easement dedicated for public
purposes in the Town of Los Gatos, County of Santa Clara, consisting of a strip of
land approximately 1715.24 square feet located along North Santa Cruz Avenue and Elm
Street, more particularly described on Exhibit "A" entitled, "Description of a
Sidewalk Easement to be Abandoned at the Northeast corner of North Santa Cruz Avenue
and Elm Street by the Town of Los Gatos", attached hereto, and shown on Exhibit "B"
entitled, "Plat to Accompany Description of Sidewalk Easement Abandonment"; and
WHEREAS, pursuant to the provisions of the Streets and Highways Code, a
Resolution of Intention was passed, a noticed hearing held, and good cause appearing
therefor.
RESOLVED, the Town Council of the Town of Los Gatos finds from all of the
evidence submitted that Sidewalk Easement along North Santa Cruz Avenue and Elm
Street described above is unnecessary for present or prospective easement purposes,
and hereby makes its order vacating the Northeast corner of North Santa Cruz Avenue
and Elm Street.
FURTHER RESOLVED, the Town Clerk shall cause a certified copy of this Order,
attested by her under the seal of the Town, to be recorded in the Office of the
County Recorder of the County of Santa Clara.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos held on 21st day of January 198_6 by the following vote:
AYES: COUNCIL MEMBERS Joanne Benjamin, Eric D. Carlson, Thomas J.
Ferrito, Brent N. Ventura, and Mayor Terrence J. Daily.
NOES: COUNCIL MEMBERS None

of California, being more particularly described as follows:
BEGINNING at the intersection of the Northeasterly line of Elm Street and the
Southeasterly line of North Santa Cruz Avenue as shown on that Record of Survey
filed for record in Book 536 of Maps at Page 51 Santa Clara County Records;
thence leaving said POINT OF BEGINNING along said Northeasterly line of Elm
Street South 64° 30'00" East, 12.00 feet to the TRUE POINT OF BEGINNING; thence
leaving said TRUE POINT OF BEGINNING and said Northeasterly line North 220,
00'00" West, 17.69 feet to a point on the Southeasterly line of North Santa Cruz

continuing along the perimeter of the proposed building the following courses
