RESOLUTION GRANTING APPEAL WITH CONDITIONS
FROM DECISION OF THE BUILDING OFFICIAL RELATING
TO HANDICAPPED ACCESS REQUIREMENTS
(15 North Santa Cruz Avenue -- Charley's Restaurant)
WHEREAS:
1. James Bacigalupi, an owner of the La Canada Building, has appealed
a decision of the Building Official as follows: requiring resloping
of the ramp to the elevator at ground elevation and installation of
new ramps inside the restaurant for the La Canada Building and
Charley's Restaurant located at 15 North Santa Cruz Avenue; and
2. A public hearing was held by the Town Council on November 18, 1985
and continued to December 16, 1985.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that a new set of plans has been
submitted to the Town which meets the approval of the Historic
Preservation Committee, the Planning Department and the Building
Official except as to the 5`/ slope instead of 2% for the ramp to
the elevator at ground elevation;
2. The Town Council further finds that pursuant to Title 24, Section
2 -422C of the California Administrative Code unreasonable hardship to
comply with Title 24 exists in that resloping the ramp to 2% would
cause drainage problems into the ground floor stores and the conse-
quential cost from the flooding of the stores would be an excessive
hardship;
3. The Town Council further finds appellant agrees to place a sign
at the front of the building on Santa Cruz Avenue directing, persons
to the elevator entrance on the other side of the building;
4. Based on the foregoing findings, the appeal is granted with
conditions as follows:
(a) the new plans on file shall be the approved plans for
the project; and
'(b) a sign shall be placed on the front of the building on
Santa Cruz Avenue directing persons to the elevator
entrance on the other side of the buidding.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by
California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos held on the 6th day of January 1986
by the following vote:
