RESOLUTION DENYING APPEAL OF GENE RUGANI FROM DECISION
OF BUILDING OFFICIAL DATED DECEMBER 12, 1980
The Town Council of the Town of Los Gatos Hereby
Resolves As Follows:
WHEREAS:
1. Gene Rugani (Appellant) owned a building
at 217 North Santa Cruz Avenue, which was substantially
destroyed by fire.
2. Appellant applied to the Town for permission
to reconstruct the subject building, and the Building Official
denied the application under Section 3.50.130 of the Zoning
Ordinance, which prohibits reconstruction of a non - conforming
building when such building is destroyed to the extent of
more than 500 of its value.
3. Appellant appealed the aforesaid decision to
the Town Council, and the Council held a duly- noticed public
hearing on the appeal and considered all evidence presented;
IT IS THEREFORE RESOLVED:
1. The Council finds that the subject building
was non - conforming at the time of the fire, and that the
fire destroyed the building to the extent of more than
500 of its value.
2. Based on the foregoing finding, the appeal
of Gene Rugani is denied.
